Monografia Acesso embargado Perfil criminológico dos psicopatas e suas implicações no direito penal brasileiro(2020) Becker, Denise DemétrioThe present work aims to analyze if there is specific and punitive legislation in the cases of people with psychopathy and discuss the importance of monitoring the convicted person after serving the sentence or security measure imposed on him, in order to prevent him from returning The research is exploratory in nature, aiming at the researcher's greater familiarity with the theme, which can be constructed based on hypotheses or intuitions. The research approach is qualitative, so that it can understand the totality of the phenomenon and emphasize the importance of events more than the researcher's interpretation. The procedure used for data collection is bibliographic research, carried out from the survey of theoretical references already analyzed, and published by written and electronic means, such as: books, scientific articles, web pages and websites. The results of the research demonstrate that there is no specific legislation for criminal psychopaths in Brazil, but two bills on the subject are being processed in the Chamber of Deputies. According to the research, it is possible to conclude that psychopaths are people who are fully aware of their actions, given that their deficiencies reside in the emotional and affective field, which is why they are often unable to control their violent impulses. This time, it is essential that specific legislation is developed for these individuals, so that they comply with a differentiated sentence regime, with individual treatment necessary while in prison and constant professional surveillance if the aptitude for freedom is proven.
