Monografia Acesso aberto Direito de personalidade: as possibilidades de alterar o nome de registro civil.(2022) Willemann, Paula Da SilvaPara identificar o indivíduo na família e sociedade tem-se o nome como elemento essencial que em regra, traz a imutabilidade como quesito de proteção em suas relações jurídicas. No entanto, determinadas situações ocorridas na vida de algumas pessoas merecem destaque para a necessidade e possibilidade de alterar o nome civil. Deste modo, esta pesquisa teve por objetivo apresentar as possibilidades dentro da esfera jurídica; de alterar o nome de registro civil. Para tanto, realizou-se uma pesquisa qualitativa, por meio de método dedutivo e com procedimento bibliográfico e documental. Com o término deste estudo foi possível verificar que o nome civil é essencial para que cada indivíduo tenha sua própria identificação, entretanto pode optar por mudá-lo desde que havendo uma motivação com razões fundamentadas, estas são considerações aceitas pelo ordenamento jurídico brasileiro para permitir essa alteração.Monografia Acesso aberto Teoria da prova: possibilidade do uso da prova obtida por meio ilícito no processo administrativo tributário(2020) Koch, Tcharles da CruzThere are in our legal tax sphere certain annoyance of understanding regarding evidence obtained by unlawful means, taking into account the deemed tax sphere, compared the other spheres of Brazilian law. The study intensifies due to the deepening of the matter, seeking to understand what the Constitution adopts, as well as its application in tax law and other areas of law, for better clarification as to the possibility of using evidence obtained by illicit means. As already mentioned, the Federal Constitution of 1988, in its article 5, LIV, safeguards the right to due process, and, consequently, in item LVI, expressed on the evidence obtained through illicit means, which must be considered inadmissible in the law suit. Following the constitutional understanding, in several areas of law, such as civil and criminal proceedings, respect in their judgments this constitutional principle, regardless of the due legal process. Contrary to the decisions made by CARF in this regard, admitting the use of evidence obtained through illicit means. As said elsewhere, those judged in the tax sphere have had a contrary understanding of the other areas of law, as a consequence, of the affront of the Federal Constitution, thus admitting the use of evidence obtained through illicit means. According to CARF, the theory of inevitable discovery takes into account when admitting the use of such evidence.
