Artigo Científico Acesso embargado Análise da (não) taxatividade do rol de decisões recorríveis por intermédio de agravo de instrumento - artigo 1.015 do Código de Processo Civil(2018) Amaral, Gabriela Silva doThis study aims to analyze the hypotheses of review, through Bill of Review (Agravo de Instrumento), listed on the article 1.015 of the Civil Procedure Code, in order to verify whether it is exhaustive or indicative, and still, if it is exhaustive, the possibility of extensive interpretation. That is because a recente decision made by the Superior Court of Justice (Superior Tribunal de Justiça) – Resp n. 1.679.909/RS – concerning that list, which was until then understood as limitative, admitted the possibility of extensive interpretation. Currently, the issue has not been decided by the Supreme Court (Supremo Tribunal Federal), for it is the object of appreciation on a “Recurso Especial Repetitivo” (Repetitive Special Appeal), under the number 988, bringing up great discussions to the judicial world, especially the legal unceartainty that potential admission of extensive interpretation may trigger in the Brazilian legal order. The conclusion of the study indicated that, among the three existing doctrinal understandings, the one that best fits the will of the legislator is that of the exhaustive list, otherwise there would be violation of the democratic process, which would cause discredit to the will of the legislator.
