Artigo Científico Acesso embargado A gratuidade como mecanismo de acesso à justiça(2018) Calazans, Gustavo KnabbenThe present work is directed to the study of Justice Free as it is a determinant mechanism of access to justice. The Federal Constitution in its art. 5, subsection LXXIV, stipulates that the State shall provide full and free legal assistance to those who prove insufficient resources to litigate. With property of fundamental right, the right to the gratuitousness of Justice, since 1950, is regulated, mainly, by means of the sexagenarian Law 1060/50 that assures to those deprived financially the access to justice gratuitous. However, NCPC / 2015 brought important changes to the term of legal aid that appeared misleadingly in Law 1060/50, since free justice was referred to, and a section dedicated exclusively to the gratuitousness of justice, not totally repealing Law 1060/50 , but only those listed in his art. 1072, III, which are now exclusively governed by the NCPC. Access to justice through the benefit of gratuitousness has come to equate the parts of a claim to a fair litigation, in addition to conferring on the individual the citizenship and dignity provided by a Democratic State of law.
