Resumo
O presente artigo pretende abordar a temática que envolve o assédio moral
praticado pelo empregador visando que o empregado concorde com o distrato
bilateral, ou resilição bilateral, materializado pelo acordo de vontades que tem por fim
extinguir um contrato de trabalho. O distrato, previsto pela Lei 13.467/2021,
denominada Reforma Trabalhista, inseriu o art. 484-A na CLT, tratando-se da
possibilidade de o empregador e o empregado rescindirem o contrato de trabalho, em
comum acordo, tendo o empregado direito a metade (50%) do aviso prévio e da multa
indenizatória do FGTS, bem como a integralidade das demais verbas trabalhistas.
Como se trata de acerto mais favorável que uma dispensa justa causa, questiona-se,
por meio de técnica bibliográfica, as consequências jurídicas de o empregador
assediar um empregado objetivando que ele aceite o distrato bilateral.
This article intends to address the theme that involves moral harassment practiced by the employer so that the employee agrees with the bilateral termination, or bilateral resiliency, materialized by the agreement of wills that aims to terminate an employment contract. The dissolution, provided for by Law 13,467/2021, called Labor Reform, inserted art. 484-A in the CLT, regarding the possibility of the employer and the employee terminating the employment contract, by mutual agreement, with the employee being entitled to half (50%) of the prior notice and the indemnity fine of the FGTS, as well as the integrality of other labor funds. As this is a more favorable agreement than a just cause dismissal, it is questioned, through bibliographic technique, the legal consequences of the employer harassing an employee with the aim of accepting the bilateral termination.
