Resumo
Os direitos dos animais e os direitos da natureza são regulamentados de forma inovadora pelas novas legislações de países da América Latina, a exemplo do Equador e da Bolívia. Assim, abrem-se novos caminhos para serem trilhados pelo Direito Constitucional. Os países que têm adotado o Novo Constitucionalismo Latino Americano têm aderido a uma visão de mundo diferente daquela predominante desde a modernidade. A visão pautada no antropocentrismo passa a dar espaço ao ecocentrismo, e muitas são as implicações disso, pois tal medida amplia a proteção à natureza. Todavia, há também uma certa diminuição na proteção dos animais individualmente considerados com a adoção do ecocentrismo, pois tal corrente só protege a natureza como um conjunto.
Animal rights and the rights of nature are regulated in an innovative way by the new legislation of Latin American countries, like Ecuador and Bolivia. Thus, new paths are opened to be traced by Constitutionalism. The countries that have adopted the New Latin American Constitutionalism have opted to a different way of view from that prevailing since modernity. The vision based on anthropocentrism gives way to ecocentrism, and many are the implications of this, because that option is more protective to nature. However, there is also a certain decrease in the protection of animals individually considered with the adoption of ecocentrism, since such current only protects nature as a whole.
