Resumo
Este trabalho é dedicado ao estudo da teoria econômica marginalista subjetivista e o direito, discorrendo sobre como, a partir de tal teoria, se desenvolveu a análise econômica do direito (AED) e a ideologia neoliberal, bem como a sua influên-cia no Estado Constitucional Brasileiro, e os entraves existentes entre tal in-fluência e a Constituição Federal de 1988. No segundo pós-guerra, com a superação dos regimes totalitários, afirmaram-se as Constituições contendo elementos normativos vinculados a valores associados principalmente à dig-nidade humana e aos direitos fundamentais. Na mesma época, contrários às noções intervencionistas e centralizadoras muito em voga no pós-Guerra, um grupo de liberais se reuniram em Mont Pélerin a fim de debater sobre as perspectivas e desafios do Liberalismo clássico. Quando acabaram por as-sumir a liderança intelectual da política, inseriu-se na esfera pública o pen-samento marginalista subjetivista. Assim, o objetivo da presente pesquisa é in-vestigar quais são as implicações da influência da Sociedade Mont Pèlerin no Estado Constitucional brasileiro. Para tanto, utilizar-se-á a pesquisa bibliográ-fica, visto que se trata de coleta de informações a partir de textos, livros, arti-gos e demais materiais de caráter científico, privilegiando estudos de teoria do direito, da economia política, e do garantismo. Ademais, pretende refletir sobre a concretização dos direitos, a democracia consubstanciada através dos direitos, os direitos fundamentais como limites aos poderes econômicos desregulados, as consequências da ideologia neoliberal para a democracia, tendo como parâmetro o garantismo jurídico de Ferrajoli.
This work is dedicated to the study of subjectivist marginalist economic theory and law, to analyzing how, from the marginalist theory, the economic analysis of law (AED) and the neoliberal ideology, as well as the influences of subjectivist marginalist economic thought, developed in the Brazilian Constitutional State, and the existing barriers between such influences and the Federal Constitution of 1988. In the second post-war, with the overcoming of totalitarian regimes, the Constitutions were affirmed containing normative elements linked to associated values mainly to human dignity and fundamental rights. At the same time, contrary to the interventionist and centralizing notions that were in vogue in the post-war period, a group of liberal economists met in Mont Pélerin to debate the perspectives and challenges of classical Liberalism. When they ended up assuming the intellectual leadership of politics, subjectivist marginalist thinking entered the public sphere. Thus, the aim of this research is to investigate what are the implications of the influence of Mont Pèlerin Society in the Brazilian Constitutional State. For this purpose, bibliographic research will be used, since it is about the collection of information from texts, books, articles and other scientific material, favoring studies of the theory of law, political economy, and guaranteeism . Furthermore, it intends to reflect on the realization of rights, democracy embodied through rights, fundamental rights as limits to unregulated economic powers, the consequences of neoliberal ideology for democracy, having Ferrajoli's legal guarantism as a parameter.
