Resumo
A presente pesquisa trata acerca da legitimidade democrática do controle jurisdicional de constitucionalidade. Tal discussão justifica-se face à necessidade da preservação do regime democrático decorrente da divisão de poderes no Estado de Direito. Assim, a investigação sobre a tradição filosófica que subjaz a atividade jurisdicional faz-se necessária para avaliar as aporias e buscar superá-las. Para tanto, foi analisada a tradição liberal, mediante as obras nucleares de John Rawls, em especial; também foi perscrutada a tradição comunitária, com apoio nos estudos de Michael Walzer e outros comunitaristas, e por fim, as atenções voltaram-se para os trabalhos dos procedimentalistas John Hart Ely e, sobretudo a Teoria Discursiva do Direito e da Democracia de Jürgen Habermas. Para tanto, utilizou-se do método científico-dedutivo, que permitiu o estudo minucioso, sem pretender exaurir, dos fundamentos de cada tradição filosófica, para ao final afirmar a hipótese de que a teoria habermasiana oferece maior legitimidade democrática ao judicial review em virtude de assegurar a cooriginariedade das autonomias pública e privada, de modo que os destinatários da norma/decisão são também seus coautores e a atribuição jurisdicional deve ser orientada a preservação democrática da gênese das leis, bem como salvaguarda dos direitos fundamentais.
This research deals with the democratic legitimacy of the judicial review. Such discussion is justified by the need to preserve the democratic regime resulting from the division of powers in the rule of law. Thus, the investigation of the philosophical tradition that underlies the jurisdictional activity is necessary to evaluate the aporias and seek to overcome them. For that, the liberal tradition was analyzed, through the nuclear of John Rawls’works, in particular; the communitarian tradition was also examined, with support in the studies of Michael Walzer and other communitarians, and finally, attention was paid to the work of the John Hart Ely procedurists and, above all, the Discourse Theory of Law and Democracy by Jürgen Habermas. In order to do so, it was used the scientific-deductive method, which allowed the detailed study, without intending to exhaust, the foundations of each philosophical tradition, in order to assert the hypothesis that the Habermasian legal theory offers greater democratic legitimacy to judicial review by virtue of ensure the cooriginality of public and private autonomy, so that the addressees of the rule / decision are also its co-authors and the jurisdictional assignment should be geared to the democratic preservation of the genesis of laws as well as safeguarding fundamental rights.
