Resumo
A presente dissertação insere-se na área de concentração Fundamentos e Efetividade do Direito e, mais especificamente, na linha de pesquisa “Democracia, processo e efetividade do Direito” do Programa de Pós-Graduação Stricto Sensu em Direito da UNIFG, visando enfrentar o tema do processo judicial eletrônico face a da garantia constitucional do acesso à justiça. Para tanto, foi utilizado a técnica bibliográfica e como método de abordagem o dedutivo, sendo que a pesquisa partiu do Projeto de Florença até a contextualização da crise da jurisdição brasileira, no intuito de verificar se foram alcançadas as propostas de melhoria do acesso à Justiça. Posteriormente apresentou-se estudo sobre o Processo Judicial Eletrônico, seus delineamentos, as questões ligadas à implementação e informatização do processo judicial, buscando alcançar o objeto central da pesquisa que visava saber se o PJe teria (in)eficiência em face da garantia constitucional do acesso à Justiça. De tal forma, utilizou-se de forma conexa o estudo dos filtros paradigmáticos e a quarta revolução industrial, visto que as questões da tecnologia e da inovação acompanham o paradigma em que vive a sociedade moderna. Por derradeiro, tratou-se de compreender o papel do PJe e a realidade social, cultural e econômica dos cidadãos brasileiro, com o pensamento na garantia constitucional do acesso à justiça. Nesse sentido, identificou-se que o PJe amplia o abismo existente entre as classes mais pobres e o acesso ao judiciário, além de não superar as questões dos altos custos que foram debatidos no Projeto de Florença de Cappelletti.
This thesis is considered to be within the area of Fundamentals and Effectiveness of Law. More specially, it was developed in the research line “Democracy, process and effectiveness of Law” at Post-Graduation Program in Law of UNIFG. The study aims to address the theme of the electronic judicial process vis-à-vis the constitutional guarantee of access to justice. For this purpose, it was opted by the bibliographical technique and the deductive method to approach the theme. Hence, the study started from the Cappelletti Florence Project to the contextualization of the crisis of the Brazilian jurisdiction, in order to verify if the proposals to improve access to justice were reached. Subsequently, an analysis of the Electronic Judicial Process was presented, as well its delineations, the issues related to the implementation and computerization of the judicial process, seeking to achieve the central object of the research that sought to know if the Electronic Judicial Process would have (in) efficiency considering the constitutional right of access the Justice. Thus, the study of paradigmatic filters and the fourth industrial revolution were used in a connected way, since the questions of technology and innovation follow the models which modern society lives in. Ultimately, the study tries to understand the role of the Electronic Judicial Process in face of the social, cultural and economic reality of Brazilian citizens, focusing on the constitutional right to access justice. In this sense, a conclusion leads to understand that Electronic Judicial Process widens the gap between the poorer classes and the access to the judiciary and, beyond, the tool does not overcome the high cost issues already discussed in the Cappelletti Florence Project.
