Resumo
O presente trabalho, que se inscreve no campo dos estudos em direito e
literatura, tem como objetivo investigar de que modo as obras de Jorge Amado
podem ser empregadas para abordar temas jurídicos, nos cursos de direito, e
quais benefícios podem ser promovidos com essa articulação. Para tanto, é
apresentado breve histórico do desenvolvimento dos estudos em direito e
literatura no âmbito mundial e brasileiro, bem como o panorama do ensino
jurídico oferecido em instituições superiores da região sul da Bahia, nas quais
inexiste a disciplina Direito e Literatura; a seguir, destaca-se o compromisso
literário e político de Jorge Amado com a realidade regional e se examina o
diálogo que Luis Alberto Warat estabelece, entre o direito e a literatura, na
conexão de sua obra A ciência jurídica e seus dois maridos com o romance Dona
Flor e seus dois maridos, de Jorge Amado; e, por fim, são oferecidas quatro
narrativas de Jorge Amado – Tenda dos milagres, Cacau, Capitães da areia e Tereza
Batista cansada de guerra –, cujos elementos figurativos podem ser utilizados
como recurso pedagógico em diferentes disciplinas do curso do direito. Tal
percurso possibilitou evidenciar a contribuição dos estudos interdisciplinares
de Direito e Literatura em sala de aula, contrapondo, ao estudo sistemático e
cientificista do ordenamento jurídico, a realidade do vivido representada na
literatura.
The present work, which is part of the study of law and literature, aims to investigate how the works of Jorge Amado can be used to address legal issues in law courses, and what benefits can be promoted with this articulation. For that, is presented a brief history of the development of studies in law and literature in the world and brazilian scope, as well as the panorama of the legal education offered in institutions superior of the south region of Bahia, in which there is no subject Law and Literature; the following stands out Jorge Amado's literary and political commitment to regional reality and examines the dialogue that Luis Alberto Warat establishes between law and literature, in the connection of his work Legal science and her two husbands with the romance Dona Flor and her two husbands, Jorge Amado; and, finally, four narratives of Jorge Amado – Tent of miracles, Cocoa, Captains of the sands and Tereza Batista: home from the wars – are presented, whose figurative elements can be used as a pedagogical resource in different disciplines of the course of law. This course made it possible to highlight the contribution of interdisciplinary studies of Law and Literature in the classroom, as opposed to the systematic and scientific study of the legal system, the reality of the lived represented in the literature.
