Resumo
O presente trabalho, que aborda o tema da (des)criminalização do aborto no Brasil, tem como objetivo investigar em que medida o tratamento dado à interrupção voluntária da gestação no Código Penal possui caráter simbólico, sendo legislação na qual se sobrepõem valores conservadores da sociedade sobre o corpo feminino e os direitos reprodutivos da mulher. Para tanto, inicialmente aborda os conceitos de símbolo e de simbólico para, então, apresentar as teorias de legislação simbólica propostas por Marcelo Neves e José Luiz Díez Ripollés. A seguir, são examinados os discursos religiosos e feministas sobre o aborto, é analisada a discussão envolvendo o tema, no âmbito das três esferas de poder, são considerados o número de abortos praticados no Brasil, em contraposição ao número de processos sobre o fato, e, por fim, a partir dos discursos e do tratamento conferido pelo Estado ao tema, são avaliadas a natureza simbólica da legislação em comento e a legitimidade da atuação do poder judiciário. Com isso, conclui-se que: a) os discursos ideológicos que se contrapõem em relação ao aborto no Brasil exercem influência sobre as decisões dos poderes executivo e legislativo, impedindo que mudanças significativas ocorram nessas esferas; b) por ser menos suscetível a interferências externas, o poder judiciário é o espaço em que ocorreram os maiores avanços acerca da interrupção voluntária da gestação no Brasil; c) embora a prática do aborto seja comum no país, os processos a ela relativos são escassos; d) independente da teoria adotada, os artigos 124 e 126 do Código Penal têm natureza de legislação simbólica, sendo legítima a atuação do poder judiciário no sentido de declarar referidos dispositivos parcialmente não recepcionados pela Constituição Federal de 1988.
The present work, which addresses the theme of (de)criminalization of abortion in Brazil, aims to investigate to what extent the treatment given to voluntary interruption of pregnancy in the Penal Code has a symbolic character, being legislation in which conservative values of society overlap the female body and the reproductive rights of women. For this purpose, it initially addresses the concepts of symbol and symbolic and then, presents the theories of symbolic legislation proposed by Marcelo Neves and José Luiz Díez Ripollés. Next, religious and feminist discourses on abortion are examined, the discussion involving the theme is analyzed, within the scope of the three spheres of power, the number of abortions practiced in Brazil is considered, in contrast to the number of lawsuits about the fact, and, finally, based on the speeches and treatment given by the State to the topic, the symbolic nature of the legislation in question and the legitimacy of the judiciary's performance are evaluated. With that, it is concluded that: a) the ideological discourses that oppose on abortion in Brazil have an influence on the decisions of the executive and legislative branches, preventing significant changes occur in these spheres; b) for being less susceptible to external interference, the judiciary is the space where the greatest advances have occurred regarding voluntary interruption of pregnancy in Brazil; c) although the practice of abortion is common in the country, the processes related to it are scarce; d) Regardless of the theory adopted, articles 124 and 126 of the Penal Code have the nature of symbolic legislation, being legitimate the action of the judiciary in the sense of declaring said partially not received devices by the 1988 Federal Constitution.
