Resumo
A monografia aqui apresentada tem como finalidade discorrer acerca da
precarização trabalhista e suas consequências, em específico, a Síndrome de
Burnout em motoristas de aplicativo acelerada pela pandemia do Covid-19 e
uberização. A metodologia utilizada é a de compilação bibliográfica e estudo de
posicionamento doutrinário, noticiário, acadêmico e jurisprudencial. Está dividida
didaticamente em cinco capítulos. Inicialmente, aborda-se sobre o trabalho e a
legislação trabalhista, tendo uma visão temporal, passando pelo surgimento do
direito trabalhista no brasil, pela constituição federal de 1988, pelos direitos
fundamentais e humanos, pelas relações de trabalho e emprego, jornadas e do
trabalho autônomo. No próximo abordaram-se a precarização das relações
trabalhistas, começando pelo início do Covid-19, o trabalho nesse período,
medidas federais e governamentais e explicação sobre a precarização
trabalhista. No seguinte, abordou-se o tema de tecnologia e uberização, uma
visão de como o mundo atual está em transformação com startups e suas
influências. Seguindo a ordem, passou-se por doenças ocupacionais,
explicando-as e dando ênfase na Síndrome de Burnout, apresentando temas da
relação jurídica em vigor e evidenciando o nexo de causalidade em motoristas
de aplicativo durante a Pandemia. Assim, o trabalho tem a intensão de contribuir
para elucidação acerca do tema apresentado e apresentar um questionamento
sobre o atual cenário legislativo trabalhista do Brasil.
The monograph presented here aims to discuss labor precariousness and its consequences, in particular, Burnout in application drivers accelerated by the Covid-19 pandemic and uberization. The methodology used is a bibliographic compilation and a study of doctrinal, news, documentary and jurisprudential positioning. It is fortress didactically in five chapters. Originally, by the federal labor law on work and by the legislation, having a temporal vision, passing through Brazil, and approaching the labor law at work by the federal law of 1988, by the fundamental rights and, by the relations of self-employment. In the next one, labor relations1, beginning of work, since the beginning of Covid-9, labor economy and pre-governance measures were addressed. In the following, the topic of technology and uberization was addressed, a vision of how the current world is changing with startups and their influences. Following the order, occupational diseases were discussed, explaining them and emphasizing the relationship of Burnout syndrome, presenting legal themes in force and highlighting the causal link in app drivers during the Pandemic. Thus, the work has the tension of contributing to the elucidation of the presented theme and presenting a questioning about the current legislative scenario in Brazil.
