Resumo
No Brasil o aborto só é permitido, legalmente, em casos de gestação oriunda de estrupo e em caso de o feto sofrer de anencefalia. Contudo, mesmo a autorização do aborto nos casos em que a gestação decorreu de estrupo é demorada, uma vez que depende do consentimento legal. Como se não bastasse todo o desgaste do processo para se obter a autorização para abortar o feto, ainda há o preconceito sustentado por ideologias autoritaristas e patriarcais que, mesmo, atualmente ainda tenta oprimir e limitar os direitos da mulher, facilitando, assim, que elas possam se tornar vítimas de linchamentos, agressões e abusos que podem as levar até a morte. Desta forma, o presente projeto delimita-se no âmbito do direito penal, em específico no artigo que tipifica o aborto como crime, ora o artigo 124 do Decreto-Lei 2.848, bem como a insegurança gerada pelo cerceamento da liberdade da gestante em não poder interromper a gravidez não desejada, uma vez que o direito à vida do feto barra o direito a liberdade da gestante.
In Brazil, abortion is only legally permitted in cases of pregnancy resulting from rape and in cases where the fetus suffers from anencephaly. However, even the authorization of abortion in cases where the pregnancy resulted from rape takes time, since it depends on legal consent. As if all the wear and tear of the process to obtain authorization to abort the fetus was not enough, there is still prejudice sustained by authoritarian and patriarchal ideologies that, even today, still try to oppress and limit women's rights, thus facilitating that they may become victims of lynching, aggression and abuse that can lead to death. In this way, the present project is delimited within the scope of criminal law, specifically in the article that typifies abortion as a crime, or article 124 of Decree-Law 2.848, as well as the insecurity generated by the restriction of the freedom of the pregnant woman in not being able to interrupt the unwanted pregnancy, since the right to life of the fetus bars the right to freedom of the pregnant woman.
