Resumo
O presente artigo busca-se analisar a uberização do trabalho como forma de exploração
produtiva e seus efeitos diretos e indiretos direitos trabalhistas e seu impacto na sociedade. A
metodologia do trabalho consistiu em um estudo bibliográfico de doutrinas, leis, artigos
científicos e jurisprudências. Compreender a natureza jurídica desta relação laboral à luz das
diferentes realidades sociais e económicas que a sociedade atravessa de forma a compreender
os seus efeitos no direito do trabalho. Atendendo às diferentes tendências económicas,
sobretudo com a chegada das plataformas digitais, também os padrões de trabalho sofreram
alterações significativas, que permitiram avanços tecnológicos, mas também criaram incertezas
para os trabalhadores que dependem destes novos recursos. A pesquisa deste relatório busca
identificar as fragilidades impostas aos trabalhadores frente às disputas teóricas e jurídicas
relacionadas às posições internacionais para garantir a proteção justa dos direitos dos
trabalhadores. Os resultados obtidos mostram que, dado o impacto das plataformas digitais no
mercado de trabalho, a uberização manifesta-se frequentemente como uma crítica à economia
colaborativa, uma tendência a favor da desregulamentação e da transição dos trabalhadores para
o trabalho por conta própria, responsabilidades da força de trabalho e instabilidade.
This article seeks to analyze the uberization of work as a form of productive exploitation and its direct and indirect effects on labor rights and its impact on society. The methodology of the work consisted of a bibliographical study of doctrines, laws, scientific articles and jurisprudence. Understand the legal nature of this employment relationship in light of the different social and economic realities that society goes through in order to understand its effects on labor law. Given the different economic trends, especially with the arrival of digital platforms, work patterns also underwent significant changes, which allowed for technological advances, but also created uncertainty for workers who depend on these new resources. The research in this report seeks to identify the weaknesses imposed on workers in the face of theoretical and legal disputes related to international positions to ensure the fair protection of workers' rights. The results obtained show that, given the impact of digital platforms on the labor market, uberization often manifests itself as a critique of the collaborative economy, a tendency in favor of deregulation and the transition of workers to self-employment, responsibilities of the workforce and instability.
