Resumo
A pesquisa objeto do presente trabalho de conclusão de curso denominado “Alimentos avoengos: a possibilidade da prisão civil dos avós pelo não pagamento diante do estatuto do idoso”, tem como objetivo demonstrar de onde vem a responsabilidade dos avós na prestação de alimentos aos netos. Para que seja possível explicar essa responsabilidade, é necessária a abordagem sobre o que se entende por alimentos, sua natureza, espécies e suas principais características, tendo em vista que se trata de um direito fundamental reconhecido por lei. A obrigação alimentar devida pelos pais é oriunda do poder familiar e são eles os devedores primários da obrigação alimentar de pai e filho, entretanto, na falta de possibilidade de cumprimento por parte dos pais, os avós, pelo princípio da solidariedade familiar, poderão ficar obrigados a prestar alimentos em sua integralidade ou complementar aos netos. Caso haja o inadimplemento desta obrigação, pode ter como consequência a prisão civil dos avós diante do não pagamento da pensão alimentícia.
The research object of this course conclusion work called “Avoengos food: the possibility of civil imprisonment of grandparents for non-payment in view of the elderly status”, aims to demonstrate where the responsibility of grandmothers in providing food to their grandchildren comes from. In order to explain this responsibility, an approach to what is meant by food, its nature, species and its main characteristics is necessary, considering that it is a fundamental right recognized by law. The alimony obligation owed by the parents comes from the family power and they are the primary debtors of the alimony obligation of father and child, however, in the absence of the possibility of compliance by the parents, the grandparents, due to the principle of family solidarity, may be obliged to provide full or supplementary food to grandchildren. Failure to comply with these obligations may result in the civil arrest of the grandparents prior to non-payment of child support.
