Resumo
“Alienação Parental e a Lei: Protegendo crianças e adolescentes" aborda a relevante questão da alienação parental e sua interseção com os direitos das crianças e adolescentes no contexto jurídico brasileiro. O principal objetivo do artigo é analisar as disposições legais vigentes relacionadas à alienação parental, examinando as medidas legais disponíveis para proteger menores envolvidos em casos dessa natureza. A pesquisa também explora a formação de uma rede de proteção, envolvendo o Estado, a família e a sociedade, no esforço conjunto de garantir os direitos fundamentais desses jovens. Utilizando uma abordagem jurídica, o artigo investiga as leis que regem o assunto, incluindo a Constituição Federal, o Código Civil, o Código de Processo Civil, o Estatuto da Criança e do Adolescente, e a Lei de Alienação Parental (Lei nº 12.318/2010). Além disso, examina as medidas legais aplicáveis para combater a alienação parental, como advertências e multas, enfatizando a importância da guarda compartilhada como forma de prevenção. Também destaca a relevância da assistência psicológica às famílias envolvidas e a necessidade de políticas públicas eficazes no âmbito jurídico. Em resumo, o artigo ilustra a evolução das leis brasileiras no combate à alienação parental, buscando criar um ambiente seguro e propício para o desenvolvimento saudável das crianças e adolescentes, reforçando assim a proteção integral desses indivíduos em situações de risco.
“Parental Alienation and the Law: Protecting Children and Adolescents” addresses the relevant issue of parental alienation and its intersection with the rights of children and adolescents in the Brazilian legal context. The main objective of the article is to analyze the current legal provisions related to parental alienation, examining the legal measures available to protect minors involved in cases of this nature. The research also explores the formation of a protection network, involving the State, family, and society, in a joint effort to guarantee the fundamental rights of people. Using a legal approach, the article investigates the laws that govern the topic, including the Federal Constitution, the Civil Code, the Civil Procedure Code, the Child and Adolescent Statute and the Parental Alienation Law (Law No. 12,318/2010). Furthermore, it examines the legal measures applicable to combating parental alienation, such as warnings and fines, emphasizing the importance of shared custody as a form of prevention. It also highlights the relevance of psychological care for the families involved and the need for effective public policies in the legal sphere. In summary, the article illustrates the evolution of Brazilian laws in combating parental alienation, seeking to create a safe environment conducive to the healthy development of children and adolescents, thus reinforcing the full protection of these individuals at risk.
