dc.description.abstractA presente pesquisa tem por escopo analisar a proteção de dados pessoais, com um enfoque especial especificamente no tratamento dos dados de crianças e adolescentes, constituindo uma análise frente a Lei N° 13.709, de 14 de Agosto de 2018 (Lei Geral de Proteção de dados), a fim de verificar se seus instrumentos são eficientes por si só para garantir a proteção dos dados em questão. Para melhor compreensão da temática, abordar-se-á no estudo como os meios digitais são utilizados por crianças e adolescentes, em razão do melhor interesse do menor. Para uma compreensão aprofundada, faz-se-a um estudo do Art. 14 da Lei Geral de Proteção de Dados, realizando uma analogia do princípio do poder familiar, demonstrando a necessidade de assegurar a proteção do menor frente as redes, relacionando-o com os direitos e garantias fundamentais, além de uma comparação da Lei Geral de Proteção de dados com as legislações vigentes voltadas à proteção e tratamento de dados de outros países, a fim de verificar a proteção do menor e a efetividade do consentimento legal.pt
dc.description.abstractThis research aims to analyze the protection of personal data, with a special focus specifically on the processing of children's and adolescents' data, constituting an analysis in front of Law No. 13,709 of August 14, 2018 (General Data Protection Law), in order to verify whether its instruments are efficient by itself to ensure the protection of the data in question. To better understand the theme, the study will be approached as digital media are used by children and adolescents, due to the best interest of the minor. For an in-depth understanding, a study of Art. 14 of the General Data Protection Law is made, making an analogy of the principle of family power, demonstrating the need to ensure the protection of the child in the face of networks, relating it to fundamental rights and guarantees, as well as a comparison of the General Data Protection Law with current legislation aimed at the protection and treatment of data from other countries, in order to verify the protection of the minor and the effectiveness of the legal consent.en
