dc.description.abstract	OBJECTIVE: To analyze the elements that underlie the recognition of inheritance rights in socio-affective paternity. METHOD: To this end, an exploratory research was conducted, with a qualitative approach, using, for data collection, the bibliographic method, since the present work was based on doctrines, jurisprudence, Brazilian legislation and scientific articles. RESULTS: Families have been undergoing significant transformations and that is why the law itself must walk in line with the new reality of these new forms of families, in order to meet the new paradigms of family evolution, seeking to protect them. and to guarantee to any individual in his home all the fundamental rights inherent in him. In this sense, it is observed that within the Family Law, the institute of affiliation has also made significant progress, including being in constant evolution, because with the new advances in family relationships, these began to assume their ties through affection, It is the affective bonds, in the present times, that constitute a family, because they are detached from the biological origin, assuming a larger extension, encompassing any origin of affiliation. In the current conjuncture, affection has been gathering its role, constituting the new link for family relationships, thus becoming the biological and non-biological affiliation species of state of affiliation. However, here are several discussions about succession law, regarding the socio-affective child, because it is in the succession field that the subject is so important. Finally, it was found that within the observed aspects, socio-affective affiliation is that resulting from the recognition of socio-affective paternity based solely on affection, disconnecting from the blood bond. CONCLUSION: Although there are situations in which the socio-affective child seeks recognition of affiliation, even if only post mortem with the intent of patrimony, the decisions are clear to recognize such an institute only if the state of child ownership remains, which presupposes three elements, namely, name, treatment and / or fame. Also, the said provision confers all responsibilities and personal effects, including property inherent to the institute of affiliation.	en
dc.description.abstract	OBJETIVO: Analisar os elementos que fundamentam o reconhecimento dos direitos sucessórios na paternidade socioafetiva. MÉTODO: Para tanto, realizou-se uma pesquisa de natureza exploratória, com a abordagem qualitativa, utilizando-se, para coleta de dados, o método bibliográfico, visto que o presente trabalho teve base doutrinas, jurisprudência, legislação brasileira e artigos científicos. RESULTADOS: As famílias têm passado por significativas transformações e, é por isso que o direito, em si, deve caminhar condizente com a nova realidade dessas novas formas de famílias, a fim de atender aos novos paradigmas da evolução das famílias, buscando protegê-las e garantir a qualquer indivíduo, inserido no seu lar, todos os direitos fundamentais a ele inerentes. Nesse sentindo, observa-se que, dentro do Direito de Família, o instituto da filiação também progrediu significativamente, encontrando-se, inclusive, em constante evolução, pois com os novos avanços nas relações familiares, essas passaram a assumir seus laços através do afeto. São os vínculos afetivos, nos tempos atuais, que constituem uma família, pois essas desligaram-se da origem biológica, assumindo uma extensão maior, abrangendo qualquer origem de filiação. Na atual conjuntura, o afeto vem angariando seu papel, constituindo o novo liame para as relações familiares, tornando-se, assim, a filiação biológica e a não biológica espécies do estado de filiação. No entanto, eis que surgem diversas discussões em relação ao Direito Sucessório, no que tange ao filho socioafetivo, pois é, no campo sucessório, que o assunto traz tanta importância. Por fim, constatou-se que dentro dos aspectos observados, a filiação socioafetiva é aquela decorrente do reconhecimento da paternidade socioafetiva baseada unicamente no afeto, desligando-se do vínculo sanguíneo. CONCLUSÃO: Apesar de existirem situações em que o filho socioafetivo busca o reconhecimento da filiação, ainda que post mortem, apenas com o intuito patrimonial, as decisões são claras ao reconhecer tal instituto apenas se restar comprovado o estado da posse de filho, o qual pressupõe três elementos, quais sejam, o nome, o trato e/ou a fama. Ainda, o referido preceito confere todas as responsabilidades e efeitos pessoais, inclusive patrimoniais inerentes ao instituto da filiação.	pt_BR
