Resumo
A ideia de seguridade social não é recente e desde período muito antigos havia esforços para
que fosse possível obter alguma proteção contra acontecimentos prejudiciais do cotidiano.
Certamente que as características atuais foram formuladas apenas com o perpassar dos anos e
a evolução das relações sociais, todavia, os primeiros esforços nesse sentido são bastante
antigos. Em todo o mundo, sistemas de seguridade social foram paulatinamente sendo
desenvolvidos e no Brasil também foi um processo longo, que atravessou diferentes
momentos até chegar às características atuais. Este estudo foi desenvolvido com o objetivo de
verificar a (in) constitucionalidade da reforma da Previdência social por meio da EC n.
103/2019, no que tange o benefício da pensão por morte. Foi realizada uma revisão
bibliográfica da literatura, visando encontrar livros, artigos, leis e julgados Para melhor
compreender o tema. Novos requisitos foram impostos à pensão por morte e ocorreu uma
mudança no cálculo, que já não é paga em valor integral, mas parte de um valor de 50%,
sendo acrescido em 10% para cada filho, limitando-se a 100%, desde que o segurado tenha
realizado 18 contribuições ou mais. Anteriormente o benefício seria recebido de forma
vitalícia, enquanto no presente apresenta limitação de tempo, até os beneficiários menores
completarem 21 anos, será vitalícia caso o dependente tenha alguma deficiência física ou
mental limitante, ou companheiro (a) com 44 anos ou mais. Para que isso se concretize, é
necessário que tenham ocorrido 18 contribuições ou mais, em caso de um período menor de
contribuições, também será menor o período de recebimento da pensão. Ocorreu uma redução
do benefício recebido em caso de óbito do segurado, surgindo uma fórmula de cálculo que
assegurará, em muitos casos, um valor total a receber menor do que teria sido recebido como
benefícios por invalidez ou aposentadoria.
The idea of social security is not new and since very ancient times there have been efforts to that it would be possible to obtain some protection against harmful everyday events. Certainly, the current characteristics were only formulated over the years and the evolution of social relations, however, the first efforts in this direction are quite old ones. Around the world, social security systems have gradually been developed countries and in Brazil it was also a long process, which went through different moments until reaching the current characteristics. This study was developed with the aim of verify the (in)constitutionality of the social security reform through EC n. 103/2019, regarding the death pension benefit. A review was carried out bibliographical literature, aiming to find books, articles, laws and judgments For better understand the topic. New requirements were imposed on the death pension and there was a change in the calculation, which is no longer paid in full, but part of a 50% value, being increased by 10% for each child, limited to 100%, as long as the insured has made 18 contributions or more. Previously, the benefit would be received in a lifetime, while at present it is limited in time, even minor beneficiaries turn 21, it will be for life if the dependent has any physical disability or limiting mental illness, or partner aged 44 or over. For this to happen, it is 18 contributions or more must have occurred, in the case of a shorter period of contributions, the period for receiving the pension will also be shorter. There was a reduction of the benefit received in the event of the insured's death, resulting in a calculation formula that will ensure, in many cases, a total amount receivable that is lower than would have been received as disability or retirement benefits.
