Resumo
O presente artigo versa sobre a possibilidade da supressão do nome dos
genitores pelo abandono afetivo. Primeiramente, buscou-se entender a transformação
constitucional e civil do conceito de abandono afetivo. Analisando-se a caracterização
do abandono afetivo, e o distinguindo do abandono material e intelectual, estes
tipificados no Código Penal brasileiro. No trabalho, foram examinadas as sanções
legais aplicáveis em casos de abandono afetivo a partir de uma análise bibliográfica
e jurisprudencial de casos concretos. Verificou-se a proteção do nome do indivíduo,
demonstrando sua previsão legal e a importância deste no desenvolvimento
individual, cultural, moral, familiar e social do sujeito. Além disso, buscou-se entender
como o nome de família identifica cada indivíduo através do sobrenome que lhe é
concebido de forma hereditária por seus genitores ao nascer, também citando, de
forma breve, sua aquisição através do casamento e da adoção, assim distinguindo as
formas de obtenção do nome de família. Por fim, examinou-se as previsões legais que
permitem a alteração do nome na Lei de Registros Públicos e a perspectiva frente ao
princípio constitucional da dignidade da pessoa humana quando se trata da supressãodo nome de família pelo abandono afetivo dos genitores.
The present article deals with the possibility of suppressing the name of the genitors for abandonment of affection. First, we sought to understand the constitutional and civil transformation of the concept of affective abandonment. After that, the characterization of affective abandonment was analyzed, distinguishing it from material and intellectual abandonment, which are typified in the Brazilian Penal Code Furthermore, the legal sanctions applicable in cases of affective abandonment were determined, through a bibliographical and jurisprudential analysis of concrete cases.The protection of the name of the individual was verified, demonstrating its legal provision and the importance of this in the individual, cultural, moral, family, and social development of the subject. Moreover, it was sought to understand how the family name identifies each individual through the surname that is hereditarily conceived by his parents at birth, also briefly mentioning its acquisition through marriage and adoption, thus distinguishing the ways of obtaining the family name. Finally, the legal provisions that allow the removal of the parents' name due to abandonment of affection as foreseen in the Public Records Law were examined, as well as the perspective on the constitutional principle of human dignity when it comes to the removal of the family name due to the parents' abandonment of affection.
