dc.description.abstract	ABSTRACT The present work aims to address the fate of the family pet after a litigious dissolution of the marriage link, examining the possibility of their joint custody in order to take care of the animal. For the development of the research, the theoretical method was used, that is based on a bibliographic review and analysis of the Brazilian legislation.. The main conclusions of this work can be summarized as follows: first of all, that recently, pets have assumed a new role within the family as family members; second, household pets as subjects of rights, and not as a object of property. Family pets holders of a specific protection that guarantees their well-being within family relationships even after a divorce. And last of all, that joint custody of pets is possible, as demonstrated by jurisprudence and that already there are bills in progress to regularize the situation of pets custody: Bill 1,058 / 2011 and Bill 1,365 / 2015. dc.description.abstract	RESUMO O presente trabalho monográfico tem como objetivo tratar sobre o destino do animal de estimação (pet) após a dissolução litigiosa da sociedade e do vínculo conjugal, examinando a possibilidade de sua guarda compartilhada. A metodologia empregada foi a pesquisa bibliográfica e documental. As principais conclusões demonstram o seguinte: a importância dos animais de estimação no seio de uma família diante do status de filho que lhe é atribuído na atualidade; que como ser senciente, o pet não pode ser visto com uma “coisa”, por isso atribuem-se a ele direitos, com as respectivas responsabilidades de seus donos no fim da sociedade conjugal; que é possível a guarda compartilhada de pet, conforme demonstra a jurisprudência; que já há projetos de lei em tramitação para regularizar a situação dos pets: Projeto de Lei 1.058/2011 e Projeto de Lei 1.365/2015.
