| dc.description.abstract | This monograph consists of the applicability of the principle of insignificance in environmental crimes or contraventions. The methodology used in the research was developed from bibliographic and documentary research, whose main sources of research will be: books, monographs, legal journals, doctrines, judgments, including online mechanisms. The main objective was to analyze the application of the principle in Environmental Law, a sphere of extreme protection and that when dealing with the issue, it causes crucial controversies regarding its applicability, also verifying how it has been approached within the Brazilian Courts and, also, how the doctrine is positioned on that topic. A study was carried out in the Brazilian Courts dated to the year 2020 whose subject of discussion is the principle of insignificance in environmental crimes / misdemeanors, therefore, glimpsed the Superior Federal Court (STF), Superior Court of Justice (STJ) and being more objective in the Santa Catarina Court of Justice (TJSC) whose jurisdiction belongs to us. It can be seen that the applicability of such a principle within the scope of environmental law is feasible, helping to relieve the judiciary and bringing more procedural speed, thus avoiding the personal wear and unnecessary reproach of the agent who suffers when passing through the criminal sphere. | en |
| dc.description.abstract | A presente monografia consiste na aplicabilidade do princípio da insignificância nos crimes ou contravenções ambientais. A metodologia utilizada na pesquisa foi desenvolvida a partir de pesquisa bibliográfica e documental, cujas principais fontes de pesquisa serão: livros, monografias, revistas jurídicas, doutrinas, julgados, inclusive mecanismos on-line. O principal objetivo foi analisar a aplicação do princípio no Direito Ambiental, esfera de extrema proteção, cujo tema causa controvérsias cruciais quanto à sua aplicabilidade. O estudo tem como objetivo, ainda, analisar o entendimento dos Tribunais brasileiros e, também, como a doutrina se posiciona sobre o referido tema. Foi realizado um estudo nos Tribunais brasileiros datado ao ano de 2020, cuja matéria de discussão é o princípio da insignificância em crimes/ contravenções ambientais, portanto, vislumbrado o Superior Tribunal Federal (STF), Superior Tribunal de Justiça (STJ) e sendo mais objetivo no Tribunal de Justiça de Santa Catarina (TJSC) cuja jurisdição nos pertence. Pode-se perceber que a aplicabilidade de tal princípio no âmbito do direito ambiental é viável, ajudando a desafogar o judiciário e trazendo mais celeridade processual, evitando, desta forma o desgaste pessoal e a reprovabilidade desnecessária do agente que sofre quando passa pela esfera penal. | pt_BR |
