| dc.description.abstract | A presente pesquisa tem como objetivo apresentar um estudo relacionado à vida do(a) ex detento, isto é, após o cumprimento da sua pena; com isso nasce o direito ao esquecimento das pessoas que pagaram uma pena decorrente de um crime cometido, com ênfase no princípio da dignidade da pessoa humana, haja vista que existe um julgamento social, o qual acaba enfatizando em um peso de pena perpétua para o(a) agente, o(a) impedindo-o(a) de exercer seus direitos e garantias fundamentais, que são inerentes à todo ser humano, mas que foram retirados durante o cumprimento de sua pena; dessa forma, objetiva-se com o presente estudo, demonstrar a importância do direito ao esquecimento para a ressocialização do apenado após a sua reeducação durante a pena, o que justifica a relevância deste trabalho que se propõe a evidenciar um olhar voltado para o direito do(a) preso(a), após o cumprimento da pena, de viver sua vida normalmente e com dignidade; O método utilizado para esse estudo foi o correlacional, com ênfase no tema 786 do STF, trazendo os princípios da proporcionalidade ou da razoabilidade; com isso fica demonstrada a magnitude do direito em evidência, isto é, o direito ao esquecimento, para que o(a) agente obtenha uma vida digna após o cumprimento de sua pena. | pt |
| dc.description.abstract | The present research aims to present a study related to the life of the former prisoner, that is, after serving his sentence; this gives rise to the right to be forgotten for people who have paid a sentence resulting from a crime committed, with emphasis on the principle of human dignity, given that there is a social judgment, which ends up emphasizing the weight of a perpetual sentence for the agent, preventing him/her from exercising his/her fundamental rights and guarantees, which are inherent to every human being, but which were withdrawn during the execution of his/her sentence; thus, the aim of this study is to demonstrate the importance of the right to be forgotten for the resocialization of the convict after their re-education during their sentence, which justifies the relevance of this work, which aims to highlight a perspective focused on the right of the prisoner, after serving his sentence, to live his life normally and with dignity; the method used for this study was correlational, with emphasis on theme 786 of the STF, bringing the principles of proportionality or reasonableness; this demonstrates the magnitude of the right in evidence, that is, the right to be forgotten, so that the agent obtains a dignified life after serving his sentence. | en |
