| dc.description.abstract | This academic work has discussed the constitutionality of the Supreme Court Precedent 370 provides that the duty to indemnify when presented the check in advance, even though the check a negotiable instrument in sight as the Law n. 7.357/85 (Law of the check). Its relevance to the discussion among scholars about the acceptance or not this summary which is a credit instrument widely used in Brazil and which had its nature changed by custom. In compiling the report was used by the deductive method from the general premise that it is unconstitutional everything that goes against the Constitution, and by providing indemnity against anyone who presents the check before the date fixed-rate, even when the law defines the check and order payment in cash, or to punish without legal provision, it is concluded that the scoresheet is unconstitutional. As the level of research it is exploratory, that was considered the level of the type of research to try and demonstrate the unconstitutionality of the problem through the exploitation of doctrines and laws. As for the procedure is the bibliography, although it works with law develops mainly through books and articles. The work is divided into three chapters, through which it seeks to demonstrate whether it be just or not that the STJ's Digest 370 is unconstitutional. | en |
| dc.description.abstract | Este trabalho acadêmico vem discutir a constitucionalidade da Súmula 370 do STJ que prevê o dever de indenizar quando apresentado o cheque de forma antecipada, mesmo sendo o cheque um título de crédito à vista conforme a Lei n. 7.357/85 (Lei do Cheque). Sua relevância deve-se à discussão entre doutrinadores acerca da aceitação ou não desta súmula que trata de um título de crédito de ampla utilização no Brasil e que teve sua natureza modificada pelo costume. Para elaboração do mesmo foi utilizado o método dedutivo por partir da premissa geral que é inconstitucional tudo o que contraria a Constituição, e ao prever indenização contra aquele que apresenta o cheque antes da data pré-fixada, mesmo quando a lei define o cheque sendo ordem de pagamento à vista, ou seja, ao punir sem previsão legal, conclui-se que a súmula é inconstitucional. Quanto ao nível da pesquisa trata-se de exploratório, sendo considerado este o nível do tipo de pesquisa ao procurar demonstrar o problema da inconstitucionalidade através da exploração de doutrinas e leis. Já quanto ao procedimento é o bibliográfico, pois embora trabalhe com leis desenvolve-se principalmente através de livros e artigos. O trabalho divide-se em três capítulos, através dos quais se procura demonstrar independente de ser justo ou não que a Súmula 370 do STJ é inconstitucional. | pt_BR |
