dc.description.abstract	The monograph goal is to analyze, based on legal and doctrinal aspects, the viability of the right to heritage of biological paternity, when the individual has been registered by an affective father. In order to do so, it analyzed the existing legislation in the current legal system, and the doctrinal understanding on the subject. The methods used, the level of research was exploratory; the approach was qualitative; the data collection procedure, was bibliographic and documentary. In the mentioned study, it was evident that the child registered under the socio-affective paternity has the right to know its biological truth, culminating in the recognition of the paternity. On the other hand, affection in the parent-child relationships is very important, allowing the child the right to dual paternity, that is, the paternal civil registration with the biological concomitant, in this way the child has access to all inherent rights to membership, from both paternities - biological and affective - on equal terms. This monograph concluded that the son can participate in the hereditary process of biological parent in three different ways: by replacing affective paternity with biological; by the addition of biological paternity to the civil registry, concomitantly to the affective one; or, in the absence of recognition of paternity, by voluntary will, made by the biological parent, allocating part of the assets to the individual.	en
dc.description.abstract	A presente monografia tem o objetivo de analisar, com base em aspectos legais e doutrinários, a viabilidade do direito à herança paterna biológica, quando o indivíduo tiver sido registrado por pai socioafetivo. Para tanto, foi analisada a legislação existente no ordenamento jurídico vigente, bem como o entendimento doutrinário a respeito do tema. Quanto aos métodos utilizados, o nível de pesquisa foi exploratório; quanto à abordagem, foi utilizada pesquisa qualitativa; quanto ao procedimento de coleta de dados, foi bibliográfico e documental. No referido estudo, restou evidente que o filho registrado sob o viés da paternidade socioafetiva, caso opte, tem direito à busca da própria ancestralidade biológica, culminando com o reconhecimento da paternidade consanguínea. Por outro lado, é de suma importância o papel do afeto nas relações paterno-filiais, o que possibilita ao filho o direito à dupla paternidade, isto é, o registro civil paterno socioafetivo concomitante ao biológico, tendo acesso, nesse caso, o filho, a todos os direitos inerentes à filiação, advindos de ambas as paternidades – biológica e socioafetiva – em igualdade de condições. Assim, a partir do referido estudo, concluiu-se que o filho pode auferir participação no acervo hereditário de genitor biológico de três formas distintas: pela substituição da paternidade socioafetiva pela biológica; pelo acréscimo da paternidade biológica ao registro civil, concomitantemente à socioafetiva; ou, por fim, na falta de reconhecimento de paternidade, por testamento voluntário, lavrado pelo genitor biológico, destinando parte dos bens ao indivíduo.	pt_BR
