Resumo
A usucapião é uma forma originária de adquirir propriedade, não dependendo da manifestação
de vontade do transmitente, ao contrário das transações de compra e venda. O procedimento
de usucapião extrajudicial surgiu da necessidade de desburocratização e alívio do sistema
judiciário. Percebeu-se que, devido às suas características, a usucapião é viável na via
extrajudicial, escapando assim da morosidade do Judiciário. Para a realização do trabalho foi
verificada a importância do estudo referente ao procedimento extrajudicial da Usucapião, o
qual demonstra maior rapidez no reconhecimento da aquisição da propriedade sem a
necessidade de processo judicial, tornando-se assim, o caminho mais célere e reduzindo a
demanda do poder judiciário. Ao satisfazer os requisitos legais, não é mais necessário recorrer
ao Judiciário para resolver a questão, o que possibilita concluir o processo de forma rápida,
segura e eficaz para todas as partes envolvidas. Esse método oferece uma alternativa eficiente
e simplificada para a aquisição de propriedade, representando um avanço significativo no
campo do direito imobiliário no Brasil. Quanto a forma de abordagem, foi adotado uma
metodologia de pesquisa descritiva, com levantamento bibliográfico legislativo baseado em
autores do direito imobiliário partindo através de análise das leis e provimentos que deram
origem ao procedimento da Usucapião extrajudicial, descrevendo sua característica e seu
conceito confirmando a hipótese da celeridade e efetividade do procedimento extrajudicial.
Adverse possession is an original way of acquiring property, not depending on the transferor's expression of will, unlike purchase and sale transactions. The extrajudicial adverse possession procedure arose from the need to reduce bureaucracy and alleviate the judicial system. It was noticed that, due to its characteristics, adverse possession is viable extrajudicially, thus escaping the slowness of the Judiciary. To carry out the work, the importance of the study regarding the extrajudicial procedure of Usucapião was verified, which demonstrates greater speed in recognizing the acquisition of property without the need for judicial proceedings, thus becoming the fastest way and reducing the demand for judicial power. By satisfying the legal requirements, it is no longer necessary to resort to the Judiciary to resolve the issue, which makes it possible to complete the process quickly, safely and effectively for all parties involved. This method offers an efficient and simplified alternative for acquiring property, representing a significant advance in the field of real estate law in Brazil. As for the approach, a descriptive research methodology was adopted, with a legislative bibliographical survey based on authors of real estate law, starting through an analysis of the laws and provisions that gave rise to the extrajudicial Usucapion procedure, describing its characteristics and its concept, confirming the hypothesis the speed and effectiveness of the extrajudicial procedure.
