Resumo
A presente monografia busca analisar a medida protetiva de manutenção do vínculo trabalhista e seus fundamentos constitucionais. O assunto abordado possui relevância, ao passo que coaduna dois temas atuais, quais sejam, violência doméstica e familiar e o direito à manutenção do vínculo do trabalho às vítimas. Não causa surpresa o resultado do prêmio Nobel de Economia do ano de 2023, no qual Claudia Goldin, professora da Universidade Harvard, logrou êxito por suas pesquisas sobre as mulheres no mercado de trabalho, aliadas ao desenvolvimento, ratificando a importância da pesquisa. Os métodos utilizados foram o exploratório, o bibliográfico e o documental. Quanto à abordagem, trata-se de uma pesquisa qualitativa. Com o estudo, foi possível perceber que a Lei Maria da Penha optou por conceder uma tutela máxima no que se refere à proteção da vítima de violência doméstica e familiar, porém insuficiente, ao passo que existem lacunas deixadas pelo legislador que necessitam de regulamentação. Na prática e na própria lei, as vítimas de violência seguem desamparadas quanto à percepção de subsídio no período de afastamento. Outras afrontas aos fundamentos constitucionais da medida protetiva de manutenção do vínculo trabalhista podem ser constatadas, desde a ausência de estabilidade após o término da medida, como a manutenção integral do salário percebido.
This monograph seeks to analyze the protective measure for maintaining the employment relationship and its constitutional foundations. The subject addressed is relevant, because it links two current themes, which are domestic and family violence and the right to maintain the employment relationship for victims. It’s not surprising that the 2023 Nobel Prize in Economics has gone to Claudia Goldin, a professor at Harvard University, in which she achieved success in her research about women on the labor market, associated with development, confirming the importance of this research. This monographic study was being conducted the exploratory, bibliographic and documental methods. About the research, approach is qualitative. In this study has been possible realize that the Maria da Penha Law has chosen for granting a maximum protection regarding to protection of victims of domestic and family violence, but not enough, because there are gaps left by legislators which require regulation. In practice and in the law itself, the victims of violence remain helpless regarding to receiving a subsidy during their away from the labor market. Other offences to the constitutional fundamentals of the protective measure to maintain the employment relationship can be find, from the lack of job stability after the measure ending to the maintenance of full salary.
