dc.description.abstract	This monographic work aims to present the importance of an effective management of pharmaceutical care in the public health network to reduce the demand for legal actions for drug supply. To achieve this objective, the method of deductive approach and monographic procedure were used. The research is exploratory, with a qualitative approach and a bibliographic procedure. From the study, it was verified that the right to health is a fundamental right of the population, being the duty of the State to promote, protect and recover health through social and economic policies. However, it is up to the judiciary to fill in the gaps left by the Executive and Legislative branches. However, in recent years there has been an excessive growth in the intervention of the judiciary for drug supply, which, despite seeking to meet the right to health of the population, causes damage to public health management, leading to distortions in health care and in public policies. It was verified that one of the factors triggering this excess of lawsuits are weaknesses existing in health policies. Therefore, the main indicators capable of guaranteeing a strengthening of pharmaceutical care in public health policies and their impact were observed. Thus, improving the effectiveness of pharmaceutical care can guarantee a real fulfillment of this fundamental right in accordance with the principles of the SUS, reducing the demand for legal actions, leading to greater attention to the right of the population and ensuring the principle of dignity of the human person.	en
dc.description.abstract	Este trabalho monográfico tem como propósito apresentar a importância de uma eficaz gestão da assistência farmacêutica na rede pública de saúde para reduzir a demanda de ações judicias para fornecimento de medicamentos. Para alcançar tal objetivo utilizou-se o método de abordagem dedutivo e procedimento monográfico. A pesquisa é de nível exploratório, de abordagem qualitativa e de procedimento bibliográfico. A partir do estudo, verificou-se que o direito à saúde é um direito fundamental da população, cabendo ao Estado o dever de promover, proteger e recuperar a saúde por meio de políticas sociais e econômicas. Porém, cabe ao poder Judiciário suprir as lacunas deixadas pelos poderes Executivo e Legislativo. Contudo, nos últimos anos houve um crescimento excessivo da intervenção do poder Judiciário para fornecimento de medicamentos, o qual, apesar de procurar atender o direito à saúde da população, provoca prejuízos para a gestão da saúde pública, levando a distorções no atendimento à saúde e nas políticas públicas. Verificou-se que um dos fatores desencadeantes deste excesso de ações judiciais são fragilidades existentes nas políticas de saúde. Portanto, foram observados os principais indicadores capazes de garantir um fortalecimento da assistência farmacêutica nas políticas públicas de saúde, e seus reflexos. Assim, melhorando a eficácia da assistência farmacêutica pode-se garantir um real atendimento a este direito fundamental de acordo com os princípios do SUS, reduzindo a demanda de ações judiciais, levando a um maior atendimento do direito da população e assegurando o princípio da dignidade da pessoa humana.	pt_BR
