Resumo
O presente trabalho objetiva analisar a influência exercida pelo racismo estrutural na utilização do reconhecimento fotográfico, demonstrando o contexto histórico de formação do racismo estrutural no Brasil e como é construída a imagem do “suspeito” ou “criminoso”. Para isso, utilizamo-nos da pesquisa bibliográfica e documental, com o objetivo de analisar, com base em livros, artigos científicos, sites, leis, entendimentos doutrinários e jurisprudenciais, a aplicação do reconhecimento fotográfico no Brasil e os reflexos do racismo estrutural no meio de prova. Dessa forma, o presente estudo analisa os principais desafios e fragilidades do reconhecimento fotográfico, sobretudo, no que tange à influência do racismo estrutural e de estereótipos raciais. Concluímos que o racismo estrutural influencia no reconhecimento fotográfico comumente utilizado como elemento informativo em sedes policiais e como meio de prova no processo penal. A influência do racismo estrutural no respectivo meio de prova ocorre através da criação de estereótipos raciais fundados na cor da pele ou traços fenótipos de determinados grupos étnico-raciais, isso acontece porque os grupos sociais historicamente discriminados e marginalizados na sociedade são, indiretamente, os mais prejudicados até os dias atuais, resultando na seletividade penal e no aumento da população negra carcerária.
The present work aims to analyze the influence exerted by structural racism on the use of photographic recognition, demonstrating the historical context of the formation of structural racism in Brazil and how the image of the "suspect" or "criminal" is constructed. To achieve this, we rely on bibliographic and documentary research, with the objective of analyzing, based on books, scientific articles, websites, laws, doctrinal understandings, and jurisprudential rulings, the application of photographic recognition in Brazil and the impact of structural racism on the evidentiary process. Thus, this study examines the main challenges and weaknesses of photographic recognition, especially regarding the influence of structural racism and racial stereotypes. We conclude that structural racism influences photographic recognition commonly used as informative elements in police headquarters and as evidence in criminal proceedings. The influence of structural racism on this means of evidence occurs through the creation of racial stereotypes based on skin color or phenotypic traits of certain ethnic-racial groups. This happens because historically discriminated and marginalized social groups are indirectly the most affected to this day, resulting in penal selectivity and the increase of the black prison population.
