Resumo
Esta monografia tem como objetivo central realizar uma investigação aprofundada sobre a Guarda Compartilhada, conforme estabelecida na lei nº 13.058 de 22 de dezembro de 2014, e avaliar sua aplicabilidade à luz do melhor interesse da criança. O estudo abrange tópicos que vão desde a definição de família e poder familiar até as diversas modalidades de guarda previstas no contexto jurídico brasileiro. A metodologia utilizada é de natureza dedutiva, com base em extensa pesquisa bibliográfica que inclui doutrinas, legislação atual e recursos eletrônicos. O cerne desta pesquisa é ressaltar a importância da aplicação da Guarda Compartilhada para promover o adequado desenvolvimento físico e emocional da criança, permitindo que ela mantenha uma convivência equilibrada e saudável com seus genitores, mesmo após a separação dos laços afetivos. A ênfase recai na necessidade de os pais priorizarem incondicionalmente o interesse superior de seus filhos após a dissolução do relacionamento conjugal. Este estudo busca contribuir para a compreensão e aprimoramento da Guarda Compartilhada como uma medida que visa salvaguardar o bem-estar das crianças no cenário jurídico e social contemporâneo.
This dissertation aims to conduct an in-depth investigation into Shared Custody, as established by Law No. 13,058 of December 22, 2014, and assess its applicability in the light of the best interests of the child. The study encompasses topics ranging from the definition of family and parental authority to the various custody modalities provided for in the Brazilian legal context. The methodology employed is deductive in nature, based on extensive bibliographic research that includes doctrines, current legislation, and electronic resources. The core of this research is to emphasize the importance of implementing Shared Custody to promote the proper physical and emotional development of the child, allowing them to maintain a balanced and healthy relationship with their parents, even after the dissolution of emotional bonds. The emphasis lies in the need for parents to unconditionally prioritize the best interests of their children following the dissolution of the conjugal relationship. This study seeks to contribute to the understanding and improvement of Shared Custody as a measure aimed at safeguarding the well-being of children in the contemporary legal and social landscape.
