Resumo
Este trabalho discute a questão da propriedade urbana no Brasil. Discorre
sobre o histórico da propriedade, sua evolução com o processo de
urbanização, trata das políticas regulatórias postas em curso até a edição da
nova política de regularização fundiária desencadeada pela Lei 13.465/2017. A
ineficácia das políticas postas em curso até então é posta em contraponto ao
potencial de regularização da nova lei. Para endossar esta tese invocamos a
Teoria da Análise Econômica do Direito como instrumento metodológico que
subsidia a discussão que permeia os momentos jurídicos desde a edição da
norma, passando pela vigência, validade e eficácia. O estudo mostra que
diferentemente de políticas anteriores, há uma possibilidade real de avanços
na redistribuição alocativa do direito de propriedade, alterando o panorama
de clandestinismo jurídico nas cidades, e como consequência, melhorando o
acesso de outros direitos constitucionalmente previstos. O estudo utiliza o
método dedutivo, que parte da generalidade da AED para a particularidade
da Lei 13.465/2017. É um trabalho revisional bibliográfico.
This paper discusses the Brazilian urban property issue. It discusses the history of the property, its evolution with the urbanization process, discusses the regulatory policies putted in curse until the edition of the new land regularization policy triggered by Law 13,465 / 2017. The ineffectiveness of the policies edited before is counteracted by the potential for regularization of the new law. To endorse this thesis, we invoke the Theory of Economic Analysis of Law as a methodological instrument that supports the discussion that permeates the legal moments since the promulgation moment, passing through its validity, validity and effectiveness. Unlike previous policies, the study shows that there is a real possibility of progress in re-allocative distribution of property rights, changing the landscape of urban legal clandestinism, and as a consequence, improving access to other rights, constitutionally provided. The study uses the deductive method, which departs from the generality of EAD for the particularity of Law 13,465/2017. It is a bibliographical revisionary work.
