dc.description.abstractO presente trabalho tem natureza da pesquisa estritamente bibliográfica, com uso de metodologia descritiva ou qualitativa, o qual teve como finalidade de estudo a Lei 11.340/06, intitulada por Lei Maria da Penha e os desafios no combate à violência contra a mulher, sob a relevância da efetividade das medidas protetivas de urgência nela inseridas. O tema em tela é de extrema relevância, porquanto em que pese a Lei Maria da Penha seja a mais efetiva, existente no país, centenas de mulheres continuam sendo mortas todas os anos, transmitindo à sociedade o sentimento de medo e impunidade, ou seja, de que a legislação pouco funciona. Nesse contexto, prefacialmente, abordou-se aspectos gerais e seu contexto histórico da violência doméstica contra a mulher. Em seguida, foi tratado sobre os tipos e ciclos de violência doméstica, inclusive o crime de feminicídio, origem da Lei Maria da Penha, além das medidas protetivas de urgência, que obrigam o agressor e protegem a ofendida. Por fim, foi desenvolvido sobre os desafios do Estado brasileiro em combater a violência doméstica contra a mulher. Conclui-se que é incontestável que a Lei Maria da Penha exaure diversas medidas de proteção à mulher, no entanto, foi possível vislumbrar que na prática tais medidas não são totalmente capazes de proteger as vítimas, colocando-as em condição, ainda, de vulnerabilidade, embora haja legislação que as proteja.pt
dc.description.abstractThe present work has the nature of strictly bibliographical research, using descriptive or qualitative methodology, which had as its study purpose Law 11.340/06, entitled Maria da Penha Law, and the challenges in combating violence against women, under the relevance of the effectiveness of the urgent protective measures included therein. The topic at hand is extremely relevant, because despite the Maria da Penha Law being the most effective in the country, hundreds of women continue to be killed every year, transmitting to society the feeling of fear and impunity, that is, that the legislation barely works. In this context, prefaced, general aspects and their historical context of domestic violence against women were addressed. Next, the types and cycles of domestic violence were discussed, including the crime of feminicide, the origin of the Maria da Penha Law, in addition to urgent protective measures, which oblige the aggressor and protect the victim. Finally, it was developed on the challenges of the Brazilian State in combating domestic violence against women. It is concluded that it is undeniable that the Maria da Penha Law exhausts several measures to protect women, however, it was possible to glimpse that in practice such measures are not fully capable of protecting victims, placing them in a vulnerable condition despite legislation that protects them.en
