| dc.description.abstract | As transformações na sociedade ocidental são sentidas na família. Esta é o agente socializador da criança e responsável pela construção de sua identidade. As relações afetivas entre pais e filhos geram novos padrões no entendimento do termo família. O objetivo deste estudo é identificar a não uniformização dos julgados no cumprimento dos direitos fundamentais da criança e do adolescente, os efeitos prejudiciais que acarretam ao seu desenvolvimento físico, psíquico e emocional, bem como a não aplicação de diretrizes invariáveis na colocação do menor em mbiente alternativo, desrespeitando, desta forma, o melhor interesse da criança e do adolescente. O método de abordagem utilizado é o dedutivo, partindo-se da legislação pátria e dos julgados, para analisar casos específicos. A técnica de pesquisa é a bibliográfica com base na doutrina, legislação e jurisprudências, com método de procedimento monográfico. Os resultados indicam que é crescente o entendimento nos Tribunais de Justiça da prioridade na continuidade da relação afetiva do menor, moldado pelo elo de amor e afeto entre pais afetivos e filhos, sobrepondo-se à ligação biológica ou interesse de um adulto. Nestes casos especiais aplica-se a flexibilização das normas legais para a proteção do interessedo menor. E, em sede de conclusão, aponta-se que a ruptura do vínculo deafetividade pode acarretar problemas irreparáveis à criança e ao adolescente, e que não há formas ou modelos a serem seguidos, mas sim uma tendência à salvaguarda e ao bem-estar psicológico de um menor | pt_BR |
| dc.description.abstract | The transformation in the Western society are feelted in the family. This one is the socializing agent and responsible for the base of their identidy. The affective relation between parents and children generated a new pattern in the understanding of the term family. The objective of this study is to identify the non uniformization of the court decisions in meeting the fundamental rights of the child and adolescent, the harmful effects that lead to their physical, mental, and emotional development, as well as the non-implementation of guidelines invariable, in placing the minor in analternative enviroment, disrespecting this way, the best interest of the child and the adolescent. The method of approach used was discursive, starting from the country legislation and courts, to analize specific cases. The technique of research is the bibliographic with base on doctrine, legislation, and jurisprudences, with a method of monographic procedure. The results indicate increase understanding in the Justice Courts of the continuation of the affective relationship of the minor, molded by the bond of love and affection, between affective parents and children, overlapping thebiological link or interest of an adult. In these special cases the legal norms applied are more flexible for the protection of the minor interest. Therefore, upon conclusion, it suggests that the cease of the bond of affection may bring unrepairable problems to the child and adolescent, and there are no formulas or models to be followed but a tendency to saveguard the minor and their psycological well bein. | en |
