dc.description.abstractThe present study aims to analyze the discussion about the possibility of applying the Principle of Insignificance by the Police Delegate in the pre-procedural phase, since, this Authority is the first to safeguard the individual rights and guarantees in the criminal area. For this purpose, the Principle of Insignificance is analyzed comprehensively, contemplating its historical evolution, foundations and functions in the scope of Crime Theory, possibility of application, legal prediction and jurisprudential understanding. It will be discussed the possibility of the aforementioned Authority applying the Principle of Insignificance in the concrete case. The method used in the development of the research was the deductive, that is to say, starting from general premises for specific data, being carried out the bibliographical and documentary research consistent in the doctrinal analysis, jurisprudential and in the current legislation. The main conclusions are that in the case of the Police Delegate before a concrete case, when analyzing the first element of the typical fact, which is precisely the criminal typology, impossible not to observe beyond the formal typicity, the material. Thus, the application of the Principle of Insignificance becomes inseparable from the exercise of the legal function attributed to it by the national legislation itself.en
dc.description.abstractO presente estudo tem como objetivo analisar a discussão acerca da possibilidade de aplicação do Princípio da Insignificância pelo Delegado de Polícia na fase pré-processual, já que tal Autoridade é a primeira a resguardar os direitos e garantias individuais no âmbito penal. Para tanto, analisa-se o Princípio da Insignificância de forma ampla, contemplando a sua evolução histórica, fundamentos e funções no âmbito da Teoria do Crime, possibilidade de aplicação, previsão legal e entendimento jurisprudencial. Explanar-se-á acerca da discussão sobre a possibilidade de a aludida autoridade aplicar o Princípio da Insignificância no caso concreto. O método utilizado no desenvolvimento da pesquisa foi o dedutivo, isto é, partindo-se de premissas gerais para dados específicos, sendo realizado a pesquisa bibliográfica e documental consistentes na análise doutrinária, jurisprudencial e na legislação vigente. As principais conclusões são no sentido de que estando o Delegado de Polícia diante de um caso concreto, ao analisar o primeiro elemento do fato típico, que é justamente a tipicidade penal, impossível não observar além da tipicidade formal, a material. Assim, a aplicação do Princípio da Insignificância torna-se inseparável ao exercício da função jurídica que a própria legislação pátria lhe atribui.pt_BR
