dc.description.abstract	The presente work was developed with the expectation to show the historical and social factors that led to the creation of the Feminicide Law in our legal system. Aiming to analyze the applicability of the law of feminicide in criminal law, demonstrating the importance of the inclusion of the femicide qualifier, addressing about the historical process of the insertion of women in society; the relationship of subordination of man to woman, which in a way made that with this system patriarchal, make women targets for domestic violence; search the diferente forms of femicide, and the assumptions of the major of the qualifier.The methodology employed, for the elaboration of this project, were used the bibliographic methods, through doctrinal works, scientific articles printed and electronic, as well as documentation research such as legislation. The present study has the objective to explain the reasons that led to the discrimination of gender in Brazil. Through the construction of a patriarch society, to the low representation of woman in the cultural and political environments. The feminist movements as major representations of changes in this discriminatory framework, reaching the alarming numbers of violence and deaths against woman, observing the results guaranteed by a State that remained inert towards the violence problem. By consequence was created the Maria da Penha Law to protect the victims of domestic violence due to the numerous aggression cases. After that, the creation of the "FemicideLaw came to tighten the sanctions at the criminal court against homicide crimes of women uniquely by the fact of being a woman.	en
dc.description.abstract	O presente trabalho foi desenvolvido com a expectativa de mostrar os fatores históricos e sociais que levaram à criação da Lei do Feminicídio no nosso ordenamento jurídico. Tendo como objetivo analisar a aplicabilidade da lei do feminicídio no direito penal, demonstrando a importância da inclusão da qualificadora do feminicídio, abordando sobre o processo histórico da inserção da mulher em meio a sociedade; a relação de subordinação do homem com a mulher, que de certa forma, fez com que este sistema patriarcal, tornassem as mulheres alvos de violência doméstica; pesquisar as diferentes formas de feminicídios, e as hipóteses da majorante da qualificadora. Utilizou-se a pesquisa bibliográfica e documental para a coleta de dados. Concluiu-se que tudo começou a partir da discriminação de gênero que perpassa a construção da sociedade patriarcal, que ensejou a baixa representatividade das mulheres nos ambientes culturais e políticos. Apresentamos os movimentos feministas como grandes representações de mudanças desse quadro discriminatório, que surgiram a partir do número alarmante de violência e morte contra as mulheres, diante de um Estado que se mostrava inerte frente ao problema da violência. Em função de uma série de movimentos sociais, foi criada a Lei Maria da Penha, com o objetivo de proteger as vítimas de violência doméstica, devido aos inúmeros casos de agressão. Por fim, adveio a criação da Lei do Feminicídio, que possui como objetivo, o enrijecimento das sanções, na seara penal, contra os crimes de homicídio de mulheres unicamente pelo fato de serem mulheres.	pt_BR
