dc.description.abstractO presente trabalho de conclusão de curso tem o intuito de tratar acerca da evolução legislativa na proteção à mulher no âmbito penal com ênfase na análise da Lei Maria da Penha e do Feminicídio. O intuito precípuo do trabalho foi evidenciar o contexto histórico da luta das mulheres ao longo dos séculos para assegurar e ter seus direitos assegurados através dos movimentos feministas do século XX após a redemocratização. É sabido que a sociedade passa por um processo evolutivo, muito embora quando se trata acerca da igualdade de gênero ainda se verifica reflexos das lutas feministas e o processo conturbado ao longo dos tempos. Desde os primórdios as mulheres são submetidas à desigualdade de gênero, mesmo com a evolução social, é possível verificar que, por muitas vezes, os direitos das mulheres são usurpados e relativizados. O problema principal identificado ao longo do trabalho permeia ao seguinte questionamento: o Estado tem agido de maneira eficaz para reduzir e coibir um dos principais problemas relacionados à violência de gênero contra a mulher no âmbito doméstico e familiar? Quanto aos objetivos específicos deste trabalho são entender como é a aplicabilidade da Lei Maria da Penha no ordenamento jurídico pátrio, bem como avaliar os avanços legislativos voltado à proteção dos direitos das mulheres, perceber a diferença entre violência de gênero, machismo estrutural e patriarcado e, por fim, analisar os avanços trazidos pela Lei Maria da Penha e a Lei do Feminicídio. No tocante a metodologia empregada para a realização deste estudo, verifica-se se tratar de um trabalho descritivo, teórico e bibliográfico, partindo da premissa de uma pesquisa qualitativa.pt
dc.description.abstractThis course conclusion work aims to address legislative developments in the protection of women in the criminal sphere with an emphasis on the analysis of the Maria da Penha Law and Feminicide. The main purpose of the work was to highlight the historical context of women's struggle over the centuries to secure and have their rights guaranteed through the feminist movements of the 20th century after redemocratization. It is known that society goes through an evolutionary process, although when it comes to gender equality there are still reflections of feminist struggles and the troubled process over time. Since the beginning, women have been subjected to gender inequality, even with social evolution, it is possible to see that, on many occasions, women's rights are usurped and relativized. The main problem identified throughout the work involves the following question: has the State acted effectively to reduce and curb one of the main problems related to gender-based violence against women in the domestic and family sphere? As for the specific objectives of this work, they are to understand the applicability of the Maria da Penha Law in the national legal system, as well as to evaluate legislative advances aimed at protecting women's rights, to understand the difference between gender violence, structural machismo and patriarchy and, finally, analyze the advances brought by the Maria da Penha Law and the Feminicide Law.
