| dc.description.abstract | No presente estudo, abordam-se os efeitos decorrentes da manutenção da qualidade de segurado em razão do gozo do auxílio-acidente. O objetivo geral é analisar a possibilidade de o segurado auferir prestação previdenciária decorrente da manutenção da qualidade de segurado por gozo do benefício de auxílio-acidente no Regime Geral de Previdência Social. Foi utilizado o método de abordagem dedutivo e a pesquisa bibliográfica, sendo a pesquisa, quanto ao nível de profundidade, exploratória. Partiu-se da análise acerca da possibilidade da manutenção da qualidade de segurado por gozo do auxílio-acidente, com o apontamento dos efeitos decorrentes do reconhecimento dessa condição no Regime Geral de Previdência Social. Trabalhou-se acerca da possibilidade do cômputo do período em gozo do auxílio-acidente como carência e tempo de contribuição. Após, apresentou-se as divergências legislativas, bem como os entendimentos doutrinários e jurisprudenciais acerca dos efeitos da manutenção da qualidade de segurado do beneficiário de auxílio-acidente, com a verificação se referido segurado poderia auferir outra prestação previdenciária nesta condição. Do estudo, constatou-se que há uma tendência jurisprudencial em possibilitar o cômputo do período em fruição do auxílio-acidente como carência, bem como tempo de contribuição, desde que verificadas as exigências legais. Com base nos resultados, conclui-se que, apesar da natureza indenizatória do benefício em comento, há que ser considerado que seu beneficiário manterá a qualidade de segurado durante sua fruição, ante a inexistência de vedação legal, possibilitando, por consequência, o cômputo do aludido lapso temporal como carência e tempo de contribuição. | pt_BR |
| dc.description.abstract | In the present study, we are addressing the effects of the maintenance of an insured due to the enjoyment of the allowance accident. The overall objective is to analyze the possibility of the insured assess pension provision resulting from the maintenance of an insured for enjoyment of the benefit of aid-accident in the General Social Security System. It used the deductive method of approach and the literature, research being the level of depth, exploratory. It started from the analysis of the possibility of maintaining quality insured by enjoyment of the aid-accident, with the appointment of the effects of the recognition of this condition in the General Social Security System. He worked up about the possibility of calculating the period of enjoyment of the aid-accident as lack of time and contribution. After, he performed legislative differences, as well as the doctrinal and jurisprudential understanding about the effects of maintaining the quality of the insured's beneficiary for state crash, checking referred insured could assess other social security benefit in this condition. From the study, it was found that there is a jurisprudential trend in enabling the calculation of the period in enjoyment of the aid-accident as grace and contribution, provided that the legal requirements checked. Based on the results, it is concluded that despite the compensatory nature of the benefit in comment, it should be considered that your beneficiary will maintain the quality insured for their enjoyment, given the lack of legal prohibition, allowing, therefore, the calculation of alluded temporal lapse as lack of time and contribution. | en |
