Resumo
O presente artigo científico tem como objetivo analisar a relação entre a alienação parental e a alteração da Lei n. 12.318/10 pela Lei n. 14.340/2022, assim como suas consequências. A metodologia empregada envolveu uma revisão bibliográfica abrangente, contemplando artigos científicos e legislação relevante. Foram pesquisadas doutrinas e dados pertinentes sobre a alienação parental, abrangendo definições, características, identificação e impactos nos envolvidos. Em seguida, foram examinadas as mudanças trazidas pela alteração da lei, analisando-se as principais modificações, suas implicações legais e a possível efetividade na prevenção e combate à alienação parental. O desenvolvimento do artigo abordou temas como definição de alienação parental, fatores contribuintes, repercussões emocionais nas crianças e direitos do genitor alienado. Houve uma análise minuciosa das alterações legislativas, destacando medidas de prevenção, conscientização e penalidades ampliadas. Conclui-se que a alteração da Lei n. 12.318/10 pela Lei n. 14.340/2022 representa um avanço no combate à alienação parental, fortalecendo a proteção das vítimas e aumentando a responsabilização dos alienadores. No entanto, enfatiza-se a importância de uma aplicação equilibrada da lei, priorizando o interesse superior da criança e a manutenção de relacionamentos familiares saudáveis. Em síntese, este artigo contribui para a compreensão da problemática da alienação parental, destacando as mudanças legislativas e suas implicações práticas, visando a conscientização, prevenção e intervenção eficaz para a proteção do bem-estar das crianças e a promoção de relações familiares saudáveis.
This scientific article aims to analyze the relationship between parental alienation and the amendment of Law n. 12.318/10 by Law n. 14.340/2022, as well as its consequences. The methodology employed involved a comprehensive literature review, including scientific articles and relevant legislation. Pertinent doctrines and data on parental alienation were researched, covering definitions, characteristics, identification and impacts on those involved. Then, the changes brought about by the alteration of the law were examined, analyzing the main modifications, their legal implications and the possible effectiveness in preventing and combating parental alienation. The development of the article addressed topics such as the definition of parental alienation, contributing factors, emotional repercussions on children and the rights of the alienated parent. There was a thorough analysis of the legislative changes, highlighting prevention measures, awareness and increased penalties. It is concluded that the amendment of Law n. 12.318/10 by Law n. 14.340/2022 represents a breakthrough in the fight against parental alienation, strengthening the protection of victims and increasing the accountability of alienators. However, theimportance of a balanced application of the law is emphasized, prioritizing the best interests of the child and maintaining healthy family relationships. In summary, this article contributes to the understanding of the problem of parental alienation, highlighting the legislative changes and their practical implications, aiming at raising awareness, prevention and effective intervention to protect the well being of children and the promotion of healthy family relationships.
