| dc.description.abstract | A presente pesquisa trata da Lei nº 12.850/2013, sob a ênfase da evolução da legislação sobre o assunto, no que tange à evolução do tipo penal autônomo e aos aspectos doutrinários que envolvem o tema. O objetivo principal da presente pesquisa é analisar os principais pontos da Lei do Crime Organizado, levando em conta as mudanças providas pelo Pacote Anticrime, e esclarecer sobre os limites da obtenção de provas na investigação das organizações criminosas no que tange à infiltração de agentes, à ação controlada e à escuta ambiental, bem como verificar o modo de operação do crime organizado no mundo e, ainda, as dificuldades trazidas às autoridades por estas. Utilizou-se, para tanto, a pesquisa bibliográfica, bem como a pesquisa documental, utilizando os próprios diplomas legais relacionados ao tema. Através deste trabalho, foi possível compreender o problema do crime organizado no Brasil e em todo o mundo, o enfrentamento e o combate por meio do Estado, demonstrando como são obtidas as provas com o foco na infiltração de agentes, na escuta ambiental e na ação controlada, bem como nas alterações advindas do Pacote Anticrime e seus limites legais. A análise dos temas abordados é de notória importância diante do crescimento exponencial do crime organizado, que, embora já atue há muito tempo, vem ampliando suas atividades e tornando quase impossível seu desmantelamento. | pt |
| dc.description.abstract | This research deals with Law 12.850 / 2013, under the emphasis of the evolution of legislation on the subject, regarding the evolution of the autonomous penal type and the doctrinal aspects that involve the subject. The major objective of this research is to analyze the main points ofthe Organized Crime Law, taking into account the changes provided by the Anti-Crime Package, to clarify the limits of obtaining evidence in the investigation of Criminal Organizations regarding Agent Infiltration, Controlled Action and Environmental Listening, as well as verifying the operation mode of Organized Crime in the world and the difficulties brought to the authorities by these. Bibliographic research was used to clarify authors of notorious legal knowledge, scientific articles, as well as documentary research using the legal diplomas related to the subject of this work. Through this work it was possible to understand the problem of Organized Crime in Brazil and around the world, the confrontation and combat through the State, demonstrating how evidence is obtained focused on Agent Infiltration, Environmental Listening and Controlled Action along with the changes arising from the AntiCrime Package and its legal limits. The analysis of the topics covered is of remarkable importance given the exponential growth of Organized Crime, which, although it has been active for a long time, has been expanding its activities and making its dismantling almost impossible. | en |
