dc.description.abstract	The family is the basis of society and, in view of this, the legal provisions of the country define their protection and protection against different occurrences, giving children an absolute attention, even in cases in which the parents no longer live together. This study is justified in view of the growth of divorce and the need to define how the care and attention of these children will be carried out even when the affective relationship of the parents has been closed. In view of the above, this work was developed with the general objective of highlighting the importance of shared custody as a way to ensure the development of the children of divorced parents, reducing the losses caused by the parents' estrangement. To reach the primary objective of the study, the specific objectives established were: to present the concepts of family in the passage of time; clarify family law; offer general data on divorce; to cite the losses resulting from the removal of the children of one of the parents after the divorce; and emphasize the law and the advantages of shared custody. A literature review was carried out to study different authors on the subject, as well as a survey of the jurisprudential positioning in the country on shared custody. It is concluded that shared custody is a custodial regime that has no focus on the children's place of residence, but rather on the broad participation of both parents in their lives, from emotional and financial support to decision-making on their life and needs. It is up to the parents, although they have difficulties of relationship between themselves, to find forms of peaceful conviviality so that the affected parties are not the children, separated from one of the parents, although they have affection for both.	en
dc.description.abstract	A família é a base da sociedade e, em face disso, os dispositivos legais do país definem sua proteção e resguardo frente a diferentes ocorrências, dando aos filhos uma atenção absoluta, mesmo nos casos em que os pais já não mais convivem em união. Este estudo justifica-se em face do crescimento do divórcio e da necessidade de definir como será realizado o cuidado e a atenção desses filhos mesmo quando o relacionamento afetivo dos pais tiver sido encerrado. Em face do exposto, este trabalho foi desenvolvido com o objetivo geral de destacar a importância da guarda compartilhada como forma de assegurar o desenvolvimento dos filhos de pais divorciados, reduzindo-se os prejuízos decorrentes do afastamento dos genitores. Para alcançar o objetivo primário do estudo, os objetivos específicos estabelecidos foram: apresentar os conceitos de família no perpassar do tempo; esclarecer o direito de família; oferecer dados gerais sobre o divórcio; citar os prejuízos decorrentes do afastamento dos filhos de um dos genitores após o divórcio; e enfatizar a lei e as vantagens referentes à guarda compartilhada. Procedeu-se de uma revisão de literatura voltada ao estudo de diferentes autores sobre o tema, bem como um levantamento do posicionamento jurisprudencial no país sobre a guarda compartilhada. Conclui-se que a guarda compartilhada trata-se de um regime de guarda que não tem foco no local de residência dos filhos, mas na ampla participação de ambos os genitores em suas vidas, desde o suporte emocional e financeiro até a tomada de decisões sobre sua vida e necessidades. Cabe aos pais, ainda que tenham dificuldades de relacionamento entre si, buscar formas de convívio pacífico para que as partes atingidas não sejam os filhos, afastados de um dos genitores, apesar de terem afeto por ambos.	pt_BR
