dc.description.abstract	The present study it seeks to analyse the possibility of occurrence of the Cyberstalking under the optical civilian and the emergence of the obligation to repairdamages by virtue of unlawful conduct in the light of civil liability. Therefore, it was used as to the type of approach the qualitative, starting from a general analysis of discourses and narratives to investigate the possibility of civil reparation by the practice of Cyberstalking.As for the procedure method, the bibliographic research was used,through doctrines, articles, electronic media and manuals.Regarding the level of research, this is characterized as exploratory in view of the analysis of discourses and narratives to seek the resolution of the topic under study.In this way, It was verified through the present study the occurrence of Cyberstalking, which consists of the virtual persecution, and its illegality from a civilian point of view, and the civil damages obligation arising in the light of civil liability.Finally, it is concluded that the virtual persecutor (cyberstalker) uses the Internet to perform disruption and persecution in the face of the victim, injuring its right to private life, which already deduces the unlawful nature of her action,as well as committing an unlawful act under the optical civilian and, therefore, indemnifying, under the terms of articles 186 and 927 of the Civil Code.	en
dc.description.abstract	O presente estudo busca analisar a possibilidade de ocorrência do Cyberstalking sob a ótica civil e o surgimento da obrigação de reparação de danos em virtude da conduta ilícita à luz da responsabilidade civil. Para tanto, foi utilizado quanto ao tipo de abordagem o qualitativo, partindo de uma análise geral de discursos e narrativas para averiguar a possibilidade de reparação civil pela prática do Cyberstalking. Quanto ao método de procedimento, foi utilizada a pesquisa bibliográfica, por meio de doutrinas, artigos, meios eletrônicos e manuais. Em relação ao nível de pesquisa, esta se caracteriza como exploratória tendo em vista a análise de discursos e narrativas para buscar a resolução do tema em estudo. Deste modo, averiguou-se por meio do presente estudo a ocorrência do Cyberstalking, o qual consiste na perseguição virtual, e o seu caráter ilícito sob a ótica civil, surgindo para o causador de danos a obrigação de reparação civil à luz da responsabilidade civil. Por fim, conclui-se que o perseguidor virtual (cyberstalker) utiliza-se da Internet para a realização de perturbação e perseguição em face da vítima, lesando o direito à vida privada desta, o que já deduz o caráter ilícito de sua ação, assim como comete ato ilícito sob a ótica civil e, portanto, indenizável, nos termos dos arts. 186 e 927 do Código Civil.	pt_BR
