dc.description.abstractO estudo histórico dos direitos fundamentais se faz necessário para entender o momento exato da inclusão dos direitos sociais no ordenamento jurídico brasileiro. Dessa forma, se torna mais fácil de se encontrar o caminho a ser tomado para os questionamentos a respeito da intervenção do judiciário nas políticas públicas, a atuação da própria política para garantir os direitos sociais e demais outros que aparecerão durante o trabalho. Espera-se trazer ao leitor sensibilidade para compreender a dificuldade da concretização dos direitos sociais por conta dos mecanismos existentes para proteção do próprio Estado, como principal agente, o embate entre a reserva do possível e o mínimo existencial, em especial ao tratar de temas como o direito à educação, saúde e moradia. Por fim, alinhar à ideia de que o judiciário tem o papel fundamental de manter a ordem entre os três poderes, garantindo que todo e qualquer direito fundamental seja observado, ainda que discricionariamente. Com isso, tem-se nítida a necessidade de intervenção que o Poder Judiciário se propõe a fazer, como forma de efetivar aqueles direitos que são deixados de lado pelo próprio Estado, sendo a discricionariedade, através da ponderação de princípios, o último recurso que o indivíduo tem, como forma de ver seus direitos garantidos.pt
dc.description.abstractThe historical study of fundamental rights is necessary to understand the exact moment of the inclusion of social rights in the Brazilian legal system. Thus, it becomes easier to find the path to be taken for questions about the intervention of the judiciary in public policies, the action of the policy itself to guarantee social rights and others that will appear during work. It is expected to bring to the reader sensitivity to understand the difficulty of the realization of social rights because of the existing mechanisms for the protection of the State itself, as the main agent, the clash between the reserve of the possible and the existential minimum, especially when dealing with issues such as the right to education, health and housing. Finally, align with the idea that the judiciary has the fundamental role of maintaining order between the three powers, ensuring that any fundamental right is observed, even if discretionarily. Thus, there is a clear need for intervention that the Judiciary proposes to make, as a way to effect those rights that are left aside by the State itself, and discretion, through the weighting of principles, is the last resort that the individual has, as a way of seeing his rights guaranteed.en
