Resumo
As religiões de matriz africana no Brasil frequentemente enfrentam atos de intolerância e discriminação, ameaçando os direitos fundamentais de liberdade religiosa e igualdade. Este estudo se propõe a investigar o papel do judiciário na proteção desses direitos e na promoção da tolerância religiosa. O objetivo principal desta pesquisa visou analisar a atuação do judiciário brasileiro em casos relacionados à intolerância religiosa contra as religiões de matriz africana, identificando os desafios e as oportunidades na proteção dos direitos fundamentais. Além disso, busca-se avaliar o impacto das decisões judiciais na promoção da tolerância religiosa e na prevenção de atos discriminatórios. A pesquisa foi conduzida por meio de uma revisão bibliográfica abrangente, que incluiu análises de decisões judiciais relevantes, estudos de caso e literatura acadêmica relacionada à intolerância religiosa e à proteção dos direitos fundamentais no Brasil. A abordagem metodológica encontra-se alinhada aos estudos qualitativos, enfocando a interpretação e análise de dados qualitativos. Os resultados fornecem insights para aprimorar as estratégias de combate à intolerância religiosa no país.
African-based religions in Brazil often face acts of intolerance and discrimination, threatening the fundamental rights of religious freedom and equality. This study aims to investigate the role of the judiciary in protecting these rights and promoting religious tolerance. The main objective of this research aimed to analyze the performance of the Brazilian judiciary in cases related to religious intolerance against religions of African origin, identifying the challenges and opportunities in the protection of fundamental rights. Furthermore, we seek to evaluate the impact of judicial decisions on promoting religious tolerance and preventing discriminatory acts. The research was conducted through a comprehensive literature review, which included analyzes of relevant court decisions, case studies and academic literature related to religious intolerance and the protection of fundamental rights in Brazil. The methodological approach is aligned with qualitative studies, focusing on the interpretation and analysis of qualitative data. The results provide insights to improve strategies to combat religious intolerance in the country.
