Resumo
Este trabalho possui a finalidade de demonstrar e apresentar o abandono afetivo, suas causas e problemas para a criança, interligado com a responsabilidade civil e o dano moral onde está estabelecido na Constituição Federal e o Estatuto da Criança e do Adolescente, fazendo a distinção conceitual de família desde o tempo romano até o atual. Mostrando a capacidade de adaptação e diferenciação da família e o conceito afetivo. Este trabalho tem por finalidade a demonstração de abranger pautas e deliberações dos Tribunais e Tribunais Superiores Brasileiros e quais suas respectivas demandas sobre este determinado assunto, qual a capacidade monetária e se eles acolhem o dano moral em questão. Abrangeremos também, a criminalidade, no qual, o abandono afetivo dos pais faz com que as crianças sem um apoio afetivo venham a ter mais capacidade da desenvoltura para a criminalidade?
The work in brief, has the purpose of demonstrating and presenting the civil responsibility and the junction with the civil liability, moral damage, where it is established in the Federal Constitution, Statute of the Child and Adolescent, making the conceptual distinction of family since the roman times until today. Showing the capacity of adaptation and differentiation, making the change also change the decisions of the courts, moreover, this work has the purpose of demonstrating to cover the agendas and deliberations of the Brazilian Courts and Superior Courts and which are their respective demands on this certain subject, what is the monetary capacity and if they accept the moral damage in question. We will also cover criminality, in which the affective abandonment of parents causes children without affective support to be more capable of developing criminality?
