| dc.description.abstract | O estudo proposto trata dos vícios de alienação na sociedade conjugal. Tem-se como objetivo demonstrar os vícios mais comuns decorrentes da inexigibilidade da vênia conjugal para alienação de bens e direitos, especialmente os móveis. Empregou-se como metodologia científica o modo dedutivo, e os objetivos da pesquisa foram delineados através do estudo exploratório. Para a coleta de dados, utilizou-se a pesquisa bibliográfica e documental. Considera-se que a falta da exigência da vênia conjugal, para alienação de bens móveis do patrimônio comum dos cônjuges e companheiros, resulta na incidência de vícios como a simulação e a fraude, assim como a ocorrência do abuso de direito. O patrimônio móvel atualmente se traduz em valores que vão além da expressividade pecuniária dos bens de raiz. A atenção legislativa dispensada aos bens imóveis diverge em demasia daquela aplicada aos bens e direitos móveis, resultando, geralmente, em prejuízo a um dos componentes da sociedade conjugal. Entende-se aplicável, como uma das soluções, a desconsideração da personalidade jurídica, no que se refere aos atos fraudulentos e abusivos ocorridos no patrimônio das sociedades empresarias. Urge a necessidade de lei especial que discipline os bens móveis comuns do casal, regulamentando a obrigatoriedade da vênia conjugal para a alienação de bens e direitos, e, assim, garantido maior segurança ao ordenamento jurídico. | pt_BR |
| dc.description.abstract | The considered study it deals with the vices of alienation in the conjugal society. It is had as objective to demonstrate to the decurrent vices most common of the unenforceability of the conjugal consent for alienation of good and rights, especially the movables. The deductive way was used as scientific methodology, and the objectives of the research had been delineated through the exploratory study. For the collection of data, it was used bibliographical research and documentary. It is considered that the lack of requirement of conjugal consent for the disposal of movable assets of the spouses and companions, results in the incidence of vices as the simulation and the fraud, as well as the occurrence of the abuse of rights. The movable patrimony currently is expressed values that go beyond the pecuniary expressivity of the real estates. The legislative attention excused to the immovable properties diverge in surplus of that one applied to the goods and mobile rights, resulting, generally, in damage to one of the components of the conjugal society. It is understood applicable, as one of the solutions, the disrespect of the corporate entity, as for the fraudulent and abusive acts occurred in the patrimony of the societies entrepreneurs. Urges the necessity of a special law that disciplines the movable common of the couple, regulating the obligatoriness of the conjugal consent for the alienation of good and rights, and, thus, guaranteed bigger security to the legal system. | en |
