| dc.description.abstract | This paper aims to identify the limits of the fundamental right of Freedom of Expression in the demonstrations carried out by the Separatist Movement "O Sul é o Meu País", in light of the Federal Constitution of 1988 and the National Security Law (n. 7.170/83). Regarding the methodology used in the development of the present work, an exploratory and qualitative research was carried out. As for the data collection procedure, the bibliographical, the documentary and the case study were used. The results of the present study were that the demonstrations by the Movement, as they are currently carried out, constitute a legitimate exercise of the fundamental right of freedom of expression and even though defying the federative pact, "O Sul é o Meu País" offers no risk to National Security. After conducting the research, it is concluded that the crime foreseen in article 11 of the National Security Law was received in part by the Federal Constitution of 1988, since it does not consider as a normative element of the type the serious threat or violence, which violates freedom of expression and the principle of the dignity of the human being when combined with articles 22, IV and 23, IV of the same Law. Thus, the limits of the fundamental right of freedom of expression in the context of the demonstrations carried out by the Separatist Movement "O Sul é o Meu País" are in the National Security Law itself, as long as that they are analyzed under the prism of the current constitutional text, in order to avoid curtailing the fundamental rights and guarantees. | dc.description.abstract | Este trabalho tem por objetivo geral identificar os limites do direito fundamental da Liberdade de Expressão nas manifestações realizadas pelo Movimento Separatista “O Sul é o Meu País”, à luz da Constituição Federal de 1988 e da Lei de Segurança Nacional (n. 7.170/83). No que tange à metodologia aplicada para realização do presente trabalho, consigna-se que foi realizada uma pesquisa exploratória e qualitativa. Quanto aos procedimentos de coleta de dados foram utilizados o bibliográfico, o documental e o estudo de caso. Os resultados do presente estudo foram que as manifestações do Movimento, da forma que são realizadas atualmente, constituem exercício legítimo do direito fundamental da liberdade de expressão e mesmo afrontando o pacto federativo, “O Sul é o Meu País” não oferece o mínimo risco para a Segurança Nacional. Após a realização da pesquisa, conclui-se que o delito previsto no artigo 11 da Lei de Segurança Nacional foi recepcionado em parte pela Constituição Federal de 1988, pois não prevê como elemento normativo do tipo a grave ameaça ou violência, o que desrespeita a liberdade de expressão e o princípio da dignidade da pessoa humana quando cumulado ou não com os artigos 22, IV e 23, IV da mesma Lei. Logo, os limites do direito fundamental da liberdade de expressão no contexto das manifestações realizadas pelo Movimento Separatista “O Sul é o Meu País” estão na própria Lei de Segurança Nacional, desde que analisados sob o prisma do texto constitucional vigente, a fim de evitar cerceamento dos direitos e garantias fundamentais.
