Since the proclamation of the Universal Declaration of Human Rights, much has been discussed about the creation of an International Court that would guarantee the application of these rights throughout the world. The Rome Statute created the International Criminal Court and raised concerns about the integration of matters considered by the Court and the legal systems of each nation. The objects of this article are the obstacles and compatibilities that exist between the Statute of the International Criminal Court and the Brazilian legal system. Therefore, it is necessary to analyze the applicability of the decisions uttered by this Court before the Constitution of the Republic of 1988, the country's Criminal Law and Criminal Procedure. From this legislative and doctrinal confrontation, the objective is to verify the constitutionality and efficiency of the applicability of the decisions handed down by the International Criminal Court in the Brazilian legal system.
