Resumo
O objetivo deste estudo foi analisar as implicações associadas à promulgação da lei
12.846/13 (anticorrupção) e da lei 13.709/2018 (LGPD), compreendidas no contexto do
programa de compliance, com foco no setor de licitações regido pela lei 14.133/2021, após
janeiro de 2024, e anteriormente pela lei 8.666/93. Este artigo propõe uma análise dos efeitos
da implementação de práticas de compliance na resolução de conflitos em processos de
licitação na administração pública. Busca-se entender como a conformidade com
regulamentos e normas, influenciam na transparência, eficiência e na accountability dos
órgãos públicos e como isso corrobora para a solução dos conflitos na esfera administrativa e
qual o seu potencial para tornar o processo mais eficiente e transparente. Para isso, adotou-se
a metodologia exploratória, com a análise dos dados obtidos através da análise bibliográfica e
documental aprofundada, bem como, de leis, doutrina, jurisprudências, dados estatísticos
oficiais, entrevista e aplicação de questionário com o responsável pelo setor.
The aim of this study was to analyze the implications associated with the enactment of Law 12.846/13 (anti-corruption) and Law 13.709/2018 (LGPD), understood within the context of the compliance program, focusing on the bidding sector governed by Law 14.133/2021, after January 2024, and previously by Law 8.666/93. This article proposes an analysis of the effects of implementing compliance practices on the resolution of conflicts in bidding processes in public administration. It seeks to understand how adherence to regulations and standards influences transparency, efficiency, and the accountability of public bodies and how this contributes to the resolution of conflicts in the administrative sphere and its potential to make the process more efficient and transparent. For this, an exploratory methodology was adopted, with the analysis of data obtained through in-depth bibliographic and documentary analysis, as well as laws, doctrine, jurisprudence, official statistical data, interviews, and the application of a questionnaire with the person responsible for the sector.
