Resumo
A presente pesquisa apresenta considerações acerca da Guarda Compartilhada com ênfase na Alienação Parental, a qual propõem-se, à luz da literatura, analisar a necessidade da criança em obter uma convivência familiar, e a tarefa dos pais em promover tal convívio, guardando e protegendo os filhos, sendo este o possível “antidoto” para combater a Alienação Parental. Neste sentido, o objetivo desse estudo, é analisar se a determinação da guarda compartilhada aos genitores que não convivem, é uma alternativa benéfica para evitar e/ou amenizar a Alienação Parental e seus efeitos. Quanto a metodologia de pesquisa, trata-se de uma pesquisa bibliográfica e investigativa, de caráter qualitativo, baseada em referenciais teóricos já existentes, como livros, artigos, dissertações, teses, a fim de confirmar a temática aqui abordada e, sobretudo, expor diferentes visões acerca do tema em questão. Diante dessas abordagens, o modo mais eficaz e correto de uma criança crescer saudável é quando os pais se encontram unidos e buscando sempre, os requisitos mais adequados para criar, proteger e educar a sua prole, mesmo que ambos não estejam unidos numa relação estável. Destarte, quando ocorrer o fim de um relacionamento, sugere-se que os genitores entrem num consenso e concordem em compartilhar a guarda, com a finalidade de manter a família unida e bem, abandonando as desavenças que possuem entre eles, já que, a separação dos pais ocasiona, em alguns casos, traumas e transtornos à vida do menor, como o sentimento de abandono. Contudo, os pais, ao aceitarem o compartilhando da guarda, estando norteando os seus filhos a compreender e a solucionar, de forma cômoda, esfinges geradas pela separação.
The present research presents considerations about Shared Guard with emphasis on Parental Alienation, which proposes, in the light of the literature, to analyze the child's need to obtain a family coexistence, and the parents' task in promoting such coexistence, guarding and protecting the children, this being the possible "antidote" to combat Parental Alienation. In this sense, the objective of this study is to analyze whether the determination of shared custody to parents who do not live together is a beneficial alternative to avoid and/or alleviate Parental Alienation and its effects. As for the research methodology, it is a bibliographical and investigative research, of a qualitative nature, based on existing theoretical references, such as books, articles, dissertations, theses, in order to confirm the theme addressed here and, above all, to expose different views on the topic in question. Faced with these approaches, the most effective and correct way for a child to grow up healthy is when the parents are united and always looking for the most adequate requirements to create, protect and educate their offspring, even if both are not united in a stable relationship. Thus, when the end of a relationship occurs, it is suggested that the parents reach a consensus and agree to share custody, in order to keep the family together and well, abandoning the disagreements they have between them, since the separation of the parents causes, in some cases, traumas and disorders to the minor's life, such as the feeling of abandonment. However, the parents, by accepting the sharing of custody, are guiding their children to understand and solve, in a comfortable way, sphinxes generated by the separation.
