Resumo
O presente artigo versará contribuir com discussões pré-existentes da aplicabilidade da legislação trabalhista no cenário dos esportes eletrônicos, estabelecendo a devida distinção de jogos e e-sports, jogadores e atletas, o reconhecimento da modalidade como prática esportiva sendo integrada no estudo do direito desportivo. Visa-se o estudo dos projetos de lei que abordam a regulamentação da prática, em face a iminente necessidade de normatização e reconhecimento dos praticantes, bem como o crescimento exponencial da demanda jurídica do nicho, uma vez que o cyber atleta dispõe de todos os requisitos conceituais e característicos de um esportista profissional, de mesmo modo que remete a uma relação empregatícia, consequentemente acarretando em uma cadeia de direitos a serem aplicados e respeitados, nesta demanda, conclusivamente com enfoque carga horária da figura do atleta desportivo. Quanto a metodologia do presente artigo, esta se deu de forma indutiva, pois partiu-se de um estudo geral da temática abordada, através de revisões bibliográficas e doutrinárias recentes, que indicam os principais pontos da matéria demandada.
The present article aims to contribute to pre-existing discussions on the applicability of labor legislation in the realm of the electronic sports, establishing the necessary distinction between games and e-sports, players and athletes, and recognizing the modality as a sports practice, integrated into the study of sports law. The focus is on studying proposed laws addressing the regulation of the practice, given the imminent need for standardization and recognition of practitioners, as well as the exponential growth of legal demands in this niche. This is particularly relevant as cyber athletes posses all the conceptual and characteristic requirements of a professional athlete, akin to an employment relationship, thereby leading to a chain of rights to be applied and respected, in this demand, conclusively focusing on the workload of the sports athlete. As for the methodology of this article, it was conducted inductively, starting with the general study of the discussed theme through recent bibliographic and doctrinal reviews, highlighting the key points of the subject matter.
